• Felony domestic violence case dismissed.  Client was facing nearly 10 years in prison if convicted of domestic violence charges involving alleged use of a deadly weapon.  After preliminary hearing in which the alleged victim was vigorously cross-examined, along with extensive negotiations with the prosecution, the case was dismissed in its entirety., 2022
• Felony DUI with great bodily injury enhancements in which victim sustained near life-threatening injuries after being hit by Client while driving a motorcycle.  Client's blood alcohol level was almost three times the legal limit.  Client was facing a double digit prison sentence and his original offer was 5 years in state prison.  After preliminary hearing and extensive negotiations with the prosecution, Ms. Yum resolved the case for probation allowing the client to avoid a lengthy prison sentence., 2022
• Misdemeanor domestic violence case alleging physical abuse and criminal threats against an Ivy-league educated physician at risk of losing his license.  Case was dismissed.  It was a highly contentious domestic violence case in which client was a physician.  He was at risk of losing his license if convicted.  After extensive investigations and negotiations with the prosecutor, Ms. Yum was able to get the case dismissed.  Client was able to maintain his license, and to continue practicing medicine., 2022
• Felony assault and battery with strike prior enhancements jury trial where client was facing multiple years in prison if convicted.  Hung jury and court declared a mistrial.  The stakes were very high in that the client was a single father who was facing highly adverse consequences if remanded into custody.  Case was resolved for zero custodial sanctions (no jail time), client was able to maintain custody of his child, and to keep his employment., 2022
• Highly contentious domestic violence and TRO trial- case dismissed.  Client was accused by his wife of allegedly engaging in domestic violence involving physical, mental, verbal, and emotional abuse.  The alleged victim called the police and kicked client out of the house by filing a TRO.  After a lengthy trial in which alleged victim and other witnesses were subject to aggressive cross-examination, the court ruled in Client's favor and dismissed the TRO.  , 2022
• Lewd or Lascivious Acts with a Minor; Aggravated Sexual Assault of a Child; and Incest.  Client was facing life in prison if convicted of nine criminal charges.  After extensive defense investigation and negotiations with the prosecutor, the entire case was dismissed., 2021
• Sexual Harassment case resolved for $1.5 million settlement., 2021
• Sexual Harassment/Sexual Assault case settled for policy limits $2 million settlement., 2021
• Multi-plaintiff sexual harassment case settled for close to $2 million settlement., 2021
• Felony domestic violence which stemmed from an attempted murder arrest.  Client was facing assault, corporal injury upon spouse, and multiple great bodily injury enhancements.  After the preliminary hearing and defense investigation revealing significant credibility issues with the complaining witness and extensive negotiations, the case was dismissed right before trial., 2021
• Felony domestic violence including corporal injury upon spouse, assault with a deadly weapon with great bodily injury enhancements.  Client was facing more than ten years in prison if convicted.  Case dismissed., 2021
• Domestic violence.  Case Dismissed.  Client was accused of battering his wife.  During a heated exchange between the client and his wife, the police were called for the domestic disturbance and the client was arrested.  After significant investigation and negotiations with the prosecution, Ms. Yum was able to get the entire domestic violence case dismissed against the client, who was at risk of losing his security clearance and job., 2020
• Lewd or Lascivious Acts on a Minor.  TRO.  Client was accused of molesting his 6-year old daughter amidst a highly contested custody and visitation case with his ex-girlfriend.  Client was investigated by both law enforcement, CPS, and the child was interviewed twice by a licensed social worker at the local children's hospital.  After extensive investigation, Ms. Yum was able to navigate her client in the process so that no criminal charges were filed against him.  After his ex filed a TRO against the client, Ms. Yum successfully defended her client including vigorously cross-examining his ex-girlfriend.  After a highly contested trial, the court found that the inflammatory accusations were not credible, and denied the TRO; in addition, the court awarded all attorney's fees and costs on behalf of the client, which meant that his ex-girlfriend was ordered to pay back attorneys fees and costs that the client incurred in defending against the accusations., 2020
• Residential burglary (felony/strike).  Case dismissed.  Client was in medical school with aspirations of becoming a future physician.  Client broke into another person's home during a drunken night and fled the scene once law enforcement arrived.  Client was at grave risk of getting suspended from school and losing a lifelong passion of pursuing a career as a doctor.  After lengthy negotiations with the prosecutor, case was dismissed with prejudice.  Client was able to stay in medical school and continue on the path of a successful career in the medical field., 2019
• Felony Assault and Battery with Strike Enhancements - Negotiated to Misdemeanor Disturbing the Peace, NO jail timeClient was charged with assaulting the complaining witness at a nightclub.  As a result of the alleged assault, complaining witness sustained extensive injuries including a fractured nose and multiple contusions to his face.  Client was acting in defense of another; specifically, he was defending his roommate from complaining witness.  Roommate was being sexually assaulted by complaining witness.  Prosecution's theory was that Client was romantically involved with his roommate and that he was jealous that complaining witness was engaged in sexual relations with his roommate.  If convicted, Client was facing jail time and a felony conviction which would qualify as a "serious or violent felony" under California's Three Strikes Law.  After lengthy negotiations and investigation, the case resolved for a misdemeanor disturbing the peace and no jail time., 2019
• Sexual Harassment and Sexual Assault Employment Case - Resolved in Mediation for More than Half a Million Dollars (Actual figure is confidential due to settlement agreement). Client was a physician's assistant who was was sexually assaulted and harassed by her supervisor while employed at a local San Diego medical center.  Client was falsely imprisoned and sexually assaulted at the workplace when her supervisor pulled her pants down and grabbed her buttocks while making unwanted sexually charged statements.  Client's supervisor then grabbed her arm while asking her to conduct sex acts on him.  Client reported the incident to her employer and law enforcement immediately.  Case resolved in mediation for over half a million dollars., 2018
• DOMESTIC VIOLENCE- CASE DISMISSEDClient was arrested for attempted murder against his girlfriend.  Victim alleged that Client strangled her and tried to kill her.  Victim sustained extensive injuries.  Client maintained that he was acting in self-defense; client also sustained extensive injuries.  Client had graduated from law school and he had endeavors to become a licensed attorney.  Any type of felony record, let alone an assault or attempted murder charge, would ruin his chances of pursuing his law career.  We conducted hours of defense investigation in preparation for Client’s case.  After meeting with the prosecution and providing information concerning our defense investigation, all charges against Client were dismissed., 2017
• Multiple counts of rape and sodomy of an intoxicated and unconscious victim- HUNG JURY.  No Jail Time.  No Lifetime Sex Offender Registration. Client was charged with multiple counts of rape and sodomy of an intoxicated and unconscious victim.  Client was a college student who allegedly committed these acts at a house party near a local college campus.  The prosecution maintained that the complaining witness was drugged while at the party and that Client forced himself upon her during her alleged intoxicated and unconscious state.  During a jury trial, the court declared a mistrial based upon the fact that the jury could not reach a unanimous decision.  It was discovered that the split ranged from 11-1 for NOT GUILTY, 10-2 for NOT GUILTY, 9-3 for NOT GUILTY, and 6-6 split.  Although Client was facing numerous years in prison, Client received NO FELONY CONVICTION, NO JAIL TIME and NO LIFETIME SEX OFFENDER REGISTRATION. , 2016
• Domestic Violence Jury Trial- NOT GUILTY.  Client is a Captain in the United States Marine Corps.  He has served our country for 17 plus years.  His wife claimed that Client brutally attacked her by allegedly throwing her down the stairs, kicking her multiple times in the stomach, hitting and slapping her, and choking her.  Wife went to the hospital and reported the alleged abuse to the medical staff and to law enforcement.  Client was subsequently arrested.  With his career on the line, Client exercised his constitutional right to a jury trial in order to combat these false allegations.  After multiple days of a strenuous jury trial, the jury voted NOT GUILTY on the more serious charge of inflicting corporal injury on a spouse.  As for the lesser offense of spousal battery, the jury was hung 9-3 in favor of NOT GUILTY.  As a result, the judge DISMISSED the lesser count.  Client received an acquittal and he was able to continue his career aspirations of serving as a high ranking officer in the USMC., 2015
• FIRST DEGREE MURDER- CASE DISMISSED AND ALL CHARGES DROPPEDClient was charged with first degree murder.  He, along with 2 co-defendants, was accused of killing the victim while at a house party.  Specifically, the prosecution alleged that the defendants were involved in a fight with the victim.  During the fight, the defendants allegedly kicked and stomped the victim to death.  Upon extensive negotiation with the prosecution and upon thorough defense investigation, the DA DISMISSED ALL CHARGES against my client.  Through investigation, it was shown that Client was not a participant of the fight and that he was not involved in the murder of the victim.  Case was dismissed with prejudice before the preliminary hearing., 2015
