Jeff Rose is a dedicated trial attorney whose practice emphasizes civil and complex civil litigation.  He focuses on plaintiff’s personal injury, environmental torts and property damage, business matters, and insurance disputes, including insurance coverage and insurance bad faith.  Before he entered private practice, Jeff served as a judicial law clerk to the Hon.   • Representing downstream landowners in Teller County, Colorado in an environmental tort case against an upstream reservoir that released of tons of fine sediment during a reservoir drawdown procedure.  The fine sediment flowed down stream, completely filling in a pond and essentially paving the river bottom.  On behalf of the downstream landowners, Mr. Rose asserted claims for trespass, nuisance, and negligence.  The case settled mid-trial for $1.625M. 

  • Representing a 17-year-old Colorado woman who was ejected from a vehicle during a one-car collision on a remote mountain pass. Mr. Rose helped to secure two six-figure policy limits settlements from the auto insurance carriers and had the settlements approved by a State of Colorado District Court Judge. 

  • Representing a Boulder, Colorado bicyclist who was hit by a car in downtown Boulder in claims against Progressive and Liberty Mutual. 

  • Representing a Front Range-area victim of sexual abuse in a widely publicized clergy abuse case.  The case settled on confidential terms. 

  • Representing a Broomfield, Colorado plumber in a subcontractor dispute where the general contractor failed to pay his subcontractors despite being paid by the business owner.  The case settled after suit was filed for the amount owed to the plumber under the contract, plus attorneys’ fees and case costs.

  • Representing a Colorado nurse who suffered a traumatic brain injury after being hit by an uninsured motorist who fled the scene of the incident in claims against Farmers Insurance for uninsured motorist benefits.  The nurse recovered a six-figure settlement.

  • Representing a Lafayette, Colorado woman who was hit by an underinsured driver in an insurance bad faith case against Farmers Insurance.  The case settled favorably on confidential terms.

  • Representing a Denver-area nurse in a wrongful death case against a major front-range delivery company.  The case settled on favorable and confidential terms. 

  • Representing a Boulder, Colorado cyclist in claims against USAA after she was hit by a large pickup truck while out on a training ride in Boulder County, Colorado.

  • Representing a Golden, Colorado renewable energy worker who was hurt in an Oklahoma car crash while traveling for work.  The case was resolved with two policy limits settlements.

  • Representing a Lafayette, Colorado pedestrian who was hit by a car while walking in a marked crosswalk across South Public Road.  After filing a lawsuit in the Boulder County District Court, the case settled favorably for six figures.

  • Representing a major directory publisher in consumer dispute negotiations, arbitrations, and lawsuits throughout the United States from 2010-2014.

  • Contingent fee agreements are a long-standing means for the non-wealthy to secure representation in civil cases, especially those concerning personal injuries or property damage.  New law impacting contingent fee agreements and changes to the rules of civil procedure risk decreasing access to justice for all but the wealthiest of individuals.  , Presenter, Access to Justice: New Law Impacting Contingent Fee Agreements, Boulder County Bar Association, 2016
  • In 2008, the General Assembly enacted C.R.S. §§ 10-3-1115 and -1116, statutes that forbid and award damages for the unreasonable delay or denial of insurance benefits. Practitioners knew that it would take time for the new statutes to play out in the courts. However, new case law reveals unanticipated consequences that require practitioners on both sides of these cases to be far more proactive when handling claims for uninsured motorist (“UM”) and underinsured motorist (“UIM”) benefits.   • January 2016 In a case set for trial in July, 2016 in the Jefferson County District Court, David Driscoll and Jeff Rose settle on favorable terms a case involving an ATV crash.  The case settled on confidential terms, 2016
  • January 2016 David Driscoll and Jeff Rose secure two underinsured motorist ("UIM") policy limit settlements on behalf of a Boulder veterinarian who was seriously injured when she, a cyclist, was hit by a car in downtown Boulder, Colorado, 2016
  • June 2016 David Driscoll and Jeff Rose secure a favorable settlement on behalf of a University of Colorado student who was rear-ended by an SUV while riding a scooter in Boulder, Colorado, 2016
  • July 2016 David Driscoll and Jeff Rose obtain a policy limits $100,000 recovery of uninsured motorist (“UM”) benefits following an April 3, 2016 incident in which an uninsured driver collided at high speed with the Toyota Avalon of an Aurora woman, causing severe injuries to her.  The injured woman’s auto insurer initially certified after the collision that the limit of UM coverage available under the policy was $25,000 per person.  In response to legal arguments made by Mr. Driscoll and Mr. Rose, the carrier reformed the policy to provide for a higher UM limit of $100,000.  The legal arguments related to the carrier’s inability to produce proof that it had offered in writing, before issuing the policy, higher UM limits to the insured, and that she had declined them, 2016
  • July 2016 Less than two months before trial and after eleven months of litigation in the Arapahoe County District Court, David Driscoll and Jeff Rose obtain a $300,000 policy limits settlement for a 60 year old Littleton, CO woman and an $70,000 settlement (still to be approved by a probate court) for her 31 year old disabled son.  Both clients were injured in a forceful rear-end auto/truck collision in Centennial, Colorado in July 2013, 2016
  • August 2016 Five weeks before a trial in the Boulder County District Court, David Driscoll and Jeff Rose obtain a $100,000 policy limit settlement for a Boulder woman in a case involving a mild traumatic brain injury resulting from a 2012 motor vehicle collision.  The defendant in the case was insured by State Farm Mutual Automobile Insurance Company, 2016
