Verdicts and Settlements:

  • Defendant's verdict.  This business litigation dispute involved two Connecticut business partners in the financial services industry. Attorney Bennett represented the Defendant. The partnership ended after 6 years. The Plaintiff subsequently sued the Defendant claiming that Plaintiff was under compensated for the entire 6 year period. Both sides retained experts in forensic accounting. Multiple depositions took place prior to trial. Prior to trial, Attorney Bennett successfully precluded the Plaintiff's lead financial expert from testifying for misconduct. Attorney Bennett later won the trial for the Defendant after showing that Plaintiff's second expert (retained shortly before trial, but permitted to testify over objection) was wrong about the accounting and the agreement terms for compensation. Attorney Bennett also showed that the opinions of Plaintiff's accounting expert were unreliable and flawed. The Plaintiff recovered no damages., 2013
  • Obtained $400,000 settlement by stiplulated judgment on eve of trial against former employees of technology company. Three employees secretly started a new business before resigning at different times to maximize their ability to take confidential information and business  opportunities of employer.  Employees were senior technology engineers and they attempted to cover their tracks after improperly taking key customer data and an important database.  Case invovled substantial computer forensic work with experts to prove misappropriation.  Attorney Bennett also uncovered evidence that one employee had destroyed an original confidentiality agreement and two others stored a stolen database at a third party location., 2012
  • Obtained successful settlement on the eve of trial for over $500,000 arising out of former employees' theft of confidential information and unfair competition.  Case involved employees starting a competing business without disclosing it to their employer.  Case involved circumstantial proof through computer generated evidence and accounting data.  Case involved discovery in three states and judicial proceedings in two states. Multiple experts were retained by both parties. , 2012
