  • Advanced Level Training on Utilizing Onset Prior to 45 Degrees to Win DUI Cases

Jonathan William McConnell recently received advanced level training, from the American Association of Premier DUI Attorneys, on utilizing the results of the Onset of Nystagmus Prior to 45 Degrees to win DUI Cases. Jonathan received training on how to win DUI Cases using the results of the Onset of Nystagmus Prior to 45 Degrees whether or not the officer observes the Onset of Nystagmus Prior to 45 Degrees. This training was provided to Association Members by Steven Glasgow. Mr. Glasgow is an AAPDA State Ambassador for Illinois. Mr. Glasgow’s office is located in Monmouth, IL and his website is found at https://www.clarkandglasgowlaw.com/.

The American Association of Premier DUI Attorneys has compiled information from Judges, Traffic Safety Resource Prosecutors (the Top DUI Prosecutors in each State), DUI Prosecutors, current Law Enforcement Officers, former Law Enforcement Officers, and DUI Defense Attorneys to determine exactly what skills, knowledge, training, tools, resources, and strategies win the most DUI cases at trial and are also used to get DUI cases successfully resolved for the defense prior to trial.

When people need a DUI Attorney, the biggest challenge is knowing whether or not an attorney truly has the skills, knowledge, training, tools, resources, and strategies that are needed to successfully resolve and win DUI cases. Countless attorneys handle DUI cases. But, only a very small percentage have the skills, knowledge, training, tools, resources, and strategies that are needed to successfully resolve and win DUI cases.

Members of the American Association of Premier DUI Attorneys have received advanced level training on the strategies that win the most DUI cases at trial and are also used to get DUI cases successfully resolved for the defense prior to trial. Members of the American Association of Premier DUI Attorneys also have access to the resources and tools that are used to win and successfully resolve DUI cases and these are resources and tools that only a very small percentage of DUI attorneys have access to and use.

Jon McConnell was inspired to pursue law because of an inherent need to help others. His father is a pastor, and Jon knew at an early age that he would either follow in his father’s footsteps or become a defense attorney. However, Jon feels the most reward when he protects someone who is at the lowest point of their lives. They don’t have a friend in the world and have nowhere else to turn. Helping others brings out the best in Jon. In order to do the most good, Jon fulfilled his calling by becoming an attorney. Jon doesn’t pass judgment on people. His job is to protect clients when it seems that everyone else is against them.

Jon has a successful and proven track record as a defense attorney. He has taught criminal justice at WSU, served as an Assistant District Attorney under Nola Foulston, and successfully prosecuted the first passenger DUI case in the State of Kansas. Jon likes challenging situations, and uses aggressive and bold tactics to defend the rights of his clients. While he maintains some traditional norms of the legal field, Jon employs a fresh and modern approach to an ancient craft. Jon McConnell’s practice is located in the historic Scottish Rite Temple in downtown Wichita, KS. • Advanced Level Training on Analyzing Drug Recognition Expert (DRE) Cases   Jonathan William McConnell, Premier DUI Attorney, Advanced Level Training on Analyzing Drug Recognition Expert (DRE) Cases. Originally published here.Jonathan William McConnell recently received advanced level training, from the American Association of Premier DUI Attorneys, on how to analyze Drug Recognition Expert (DRE) cases. Jonathan received training on the systematic and standardized 12-step procedure that Drug Recognition Experts are required to follow when conducting a Drug Recognition Expert Evaluation on a suspect. The 12-step procedure is commonly not followed by Drug Recognition Experts and this results in inaccurate opinions formed by law enforcement “experts” and people being wrongfully prosecuted for DUI. • Advanced Level Training on Invalidating the Results of the Walk and Turn and the One Leg Stand Tests   Jonathan William McConnell recently received advanced level training, from the American Association of Premier DUI Attorneys, on how to easily and effectively invalidate the results of the Walk and Turn and the One Leg Stand Tests. Officers will testify that they conducted the Walk and Turn and the One Leg Stand Tests properly. However, in almost every case, officers conduct the tests improperly by doing one or more of the following: giving wrong instructions, giving improper demonstrations, failing the test themselves during their own demonstration of the test, and improperly assessing a person’s performance on the tests. Jonathan received training on exactly what to look for during the Walk and Turn and the One Leg Stand Tests and how to invalidate the tests by using the officer’s own National Highway Traffic Safety Administration (NHTSA) Manuals against them in the courtroom. • Advanced Level Training on Effectively Educating Clients During the Initial Consultation   Jonathan William McConnell recently received advanced level training, from the American Association of Premier DUI Attorneys, on how to effectively educate clients during the initial consultation. It is critical for clients to understand that DUI investigations are standardized nationally, you have access to all of the officer’s training materials, the DUI investigation is only scientifically reliable if the investigation is done correctly, and you will be able to identify every mistake that the officer made and every area where the officer did not conduct the investigation by the book. It is important for clients to understand that is not them versus the cop, rather it is the book versus the cop. Clients need to be armed with all of the information they need in order for them to make an educated decision about how they would like to proceed with their case. This training was provided by Nicolas Geman, a Colorado State Ambassador for the American Association of Premier DUI Attorneys. Nicolas Geman is based out of Denver, Colorado and his website is https://www.gemancriminaldefense.com/., 2021
  • Advanced Level Training on Fighting Marijuana (Cannabis) DUI Cases   Jonathan William McConnell recently received advanced level training, from the American Association of Premier DUI Attorneys, on how to fight Marijuana (Cannabis) DUI Cases. It is critical for attorneys to understand the general and clinical indicators that law enforcement officers are trained to look for in marijuana cases and to know the alternative causes for these indicators. Importantly, the National Highway Traffic Safety Administration (NHTSA) states that marijuana impairment can rapidly diminish between 1 and 2 1/2 hours, that some metabolites are non-impairing, and that concentrations of metabolites found in a person’s system cannot be tied to impairment. In fighting and winning marijuana DUI cases, it is important to know that the Standardized Field Sobriety Tests are not effective in detecting marijuana impairment. This training was provided by Trey Tull, a Standardized Field Sobriety Testing Instructor Member of the American Association of Premier DUI Attorneys and he is based out of West Monroe, Louisiana. • Advanced Level Training on Determining if Police DUI Videos Have Been Altered   Jonathan William McConnell recently received advanced level training, from the American Association of Premier DUI Attorneys, on how to determine if Police DUI Videos have been altered. It is unfortunately all too common for prosecutors and the police to alter DUI videos in an effort to hide evidence that shows a person is not guilty. Because of this, it is critical for defense attorneys to understand what to look for in videos that have been redacted or videos that contain looping and frame insertion. Additionally, defense attorneys should pay close attention to whether or not they are receiving a first-generation copy that includes subtitles and metadata or if the subtitles and the metadata have been purposely removed from the video. This training was provided by Paul Gordon, a Video Analysis Expert Member of the American Association of Premier DUI Attorneys. Paul is based out of Moore, Oklahoma and his website address is https://www.sortrainingcenter.com/. Jonathan W. McConnell, the founding criminal defense attorney at the McConnell Law Firm, specializes in criminal defense, including Driving Under the Influence (DUI), false sexual accusations, white collar crime and appeals. He is also highly experienced in traffic law and civil litigation.  As a noted criminal defense attorney and the leader of our firm, Jon is known for his expert knowledge and unmatched tenacity. He describes his technique as aggressive and “outside the box,” utilizing a fresh and modern approach. Both the public and his peers have taken notice, consistently rating him at the top of the profession with the most prestigious legal directories: Avvo, The National Trial Lawyers, Super Lawyers and Martindale-Hubbell.  Jon was drawn to the legal profession out of a desire to help people. The Wichita native earned bachelor’s and master’s degrees in criminal justice from Wichita State University, then attended law school in Miami, Florida. After his education, he gained experience as a Law Clerk for a judge in Broward County, Florida, as an Assistant District Attorney of Sedgwick County, Kansas, and then at a criminal defense law firm.  Jon founded his own namesake law firm in 2014, and the practice was rebranded in 2017 as the McConnell Law Firm. He feels that there is great honor in the work we do, especially in helping those who are in trouble or who have made a mistake, which is why he fights tirelessly to represent each of his clients— leaving no stone unturned in the process.  Jon is passionate about making a difference through volunteerism and monetary support. He has been actively involved with the Midwest Innocence Project, which is dedicated to the investigation, litigation and exoneration of the wrongfully convicted. We have recently provided support to the National Association for the Advancement of Colored People (NAACP), The Kansas African American Museum, the Wichita Wagonmasters Good Life Grants and, in honor of Jon’s late mother, the Wichita Cancer Foundation and The University of Kansas Cancer Center. , 2021
  • Advanced Level Training on Winning DUI Cases With Divided Attention   Jonathan William McConnell recently received advanced level training, from the American Association of Premier DUI Attorneys, on how to win DUI cases with divided attention. Almost everything that an officer is trained to do and look for during a DUI investigation is related to divided attention impairment. In most DUI cases, that are worthy of fighting at trial, there is very little or no divided attention impairment. Officers are trained by the National Highway Traffic Safety Administration (NHTSA) that alcohol and/or drug impaired drivers will not be able to divide their attention. Thus, it is critical for a defense attorney to know each and every area in a case where they can show that there was no divided attention impairment. In these cases, where no divided attention impairment is present, the officer will then be forced, during cross-examination, to explain to the Judge/Jury that the driver was not under the influence of alcohol and/or drugs and they are not-guilty of DUI. This training was provided by Dave Cox, a DUI Defense Expert, and the Founder and President of the American Association of Premier DUI Attorneys. • Advanced Level Training on Vehicle Forensics In DUI Investigations   Jonathan William McConnell recently received advanced level training, from the American Association of Premier DUI Attorneys, on vehicle forensics in DUI Investigations. In accident cases, cases where a driver is no longer at a vehicle when the police arrive, and cases involving a question as to whether a driver was distracted versus being impaired, the defense can use data for their benefit. This includes location data tracking, cell phone data, and crash data. A skilled defense team will be able to potentially use this data to prove that their client is not guilty. Additionally, in accident cases where airbags were deployed, it is important to understand that airbag deployment can cause symptoms similar to alcohol intoxication and can also cause an adversely high breath test result. This training was provided by Travis Jones, an AAPDA Member, who is an Accident Reconstruction Expert and a Breath Testing Expert. Travis is based out of St Peters, Missouri and he provides nationwide consulting and expert witness services. • Advanced Level Training on Attacking DUI Reports & Videos   Jonathan William McConnell recently received advanced level training, from the American Association of Premier DUI Attorneys, on attacking DUI reports and videos in DUI cases. To effectively attack DUI reports and videos, it is critical to know and use the officer’s NHTSA Manuals against him. Even the most experienced officers miss important steps and make mistakes in DUI investigations, which can result in people being wrongfully arrested for DUI. Some key areas to focus attention on are: discrepancies between the police report and the video, officers who ignore/downplay/neglect injuries and medical conditions, the officer’s instructions and demonstrations of the field sobriety tests, an officer’s use of trick questions, improper classification of clues, copy and pasting errors, misused keywords, and poor quality reports when a video is present. This training was provided by Peter Krantz, a former law enforcement officer who was a Drug Recognition Expert and a Standardized Field Sobriety Testing Instructor. Peter has transitioned out of law enforcement and is now in law school to become an attorney who will defend people who are arrested for DUI. • Advanced Level Training on Winning DUI Cases Using Finger Dexterity Jonathan William McConnell recently received advanced level training, from the American Association of Premier DUI Attorneys, on winning DUI cases using finger dexterity. It is critically important to understand that officers are trained that alcohol goes to the muscles and, if a person is impaired, the alcohol in the muscles will cause finger dexterity problems. The main area in a case where officers are trained to look for finger dexterity issues is while the driver is retrieving their Driver’s License, registration, and proof of insurance and providing those documents to the officer. Officers are trained that alcohol in the muscles will cause a driver to fumble and drop their documents. If a driver doesn’t have any finger dexterity problems, we can get an officer to testify that the driver did not have an impairing amount of alcohol in their system at that time. Additionally, there are many overlooked areas in a case where skilled attorneys can also look for evidence that their client did not have finger dexterity issues. It is critical to hire an attorney who understands the importance of looking for the lack of finger dexterity problems in a case and knows how to use that information to force an officer to explain to the Judge or the Jury that the client is not guilty. This training was provided by Dave Cox, the Founder and President of the American Association of Premier DUI Attorneys. Honors/Awards:
  • Jonathan W. McConnell, founding Wichita criminal defense lawyer at the McConnell Law Firm, was recently awarded the coveted Golden Chalice in recognition of his contributions to the Knights Templar Eye Foundation. The Knights Templar is a subset of the York Rite of Freemasonry, a Christian-based branch of Freemasonry, and the Knights Templar Eye Foundation is their primary charity and source of philanthropic work. “I initially wanted to join and support the Knights Templar because of their involvement with pediatric vision loss. My grandfather grew up with poor vision as a child, but his family did not possess the means to purchase the proper glasses he needed to see. Much of the charity that he did in his own life was centered around children’s vision loss,” said McConnell. “I believed that the Knights Templar Eye Foundation would be a great way for me to honor my grandfather while giving back to the community.”   About the Knights Templar Eye Foundation The Knights Templar Eye Foundation, originally founded in 1956, is sponsored by the Grand Encampment of Knights Templar and has expended over $156 million on patient care, research and education, with research grants totaling over $28 million awarded to researchers in the fields of pediatric ophthalmology and ophthalmic genetics. According to the foundation, its original mission was “to provide assistance to those who face loss of sight due to the need for surgical treatment without regard to race, color, creed, age, sex or national origin provided they are unable to pay or receive adequate assistance from current government agencies or similar sources and to provide funds for research in curing diseases of the eye.” Today, their mission remains to improve vision through research, education, and access to care.   That Others May See Within the York Rite of Freemasonry, there are different subsets, with the final body a member can join being the “commandery” before reaching the status of a Knight Templar, the highest degree in the York Rite. McConnell followed this traditional approach, joining the commandery before becoming a Knight Templar and supporting the efforts of their charity through financial contributions. Each year, the Golden Chalice is awarded in recognition of a single donation of a previously set amount and may be applied to the Permanent Donor Fund. Most recently, McConnell was presented with a Golden Chalice adorned with the inscription “That Others May See” in special recognition of his generous donation to the foundation. The history of the chalice and its inscription dates back to the Knights Templar original mission and pays homage to the organization’s Christian-based heritage during the Crusades. Those struggling with vision issues as a child are at a natural disadvantage and are forced to find other ways to learn. With financial contributions like McConnell’s, the foundation has been able to help children have proper vision so that they may see, get ahead in life, and continue to learn. “In Masonry, we are often asked about what we seek. In general, we seek light,” said McConnell. “And, we seek the knowledge of information so that others may see the light, learn, and have this same thirst for knowledge.”, Golden Chalice Recipient, Knights Templar Eye Foundation, 2021
