Attorney Matthew Wagoner is the founder of The Wagoner Firm, PLLC, in Albany, New York, and practices in the areas of business and corporate law. Mr. Wagoner received a bachelor’s degree from Old Dominion University and went on to earn his law degree from Albany Law School, graduating cum laude. He has also served as a certified mediator through Albany Law School since 2006 and has taken a course in effective time management from Franklin Covey.

Admitted to practice law in the state of New York since 2008, Mr. Wagoner is also licensed to appear before the U.S. District Courts for the Western and Northern districts of New York. Before founding his firm, Mr. Wagoner gained legal experience clerking for a Supreme Court Justice in New York City. During this time, he worked in a wide range of business and corporate matters and gained experience in negotiating settlements.

Mr. Wagoner’s additional legal experience includes working for a private New York based firm. In this role, he represented a variety of business and corporate clients in matters involving corporate governance issues, regulatory compliance and other commercial litigation.

Outside of his law practice, Mr. Wagoner enjoys volunteering with business related groups. He serves as an organizer for 1 Million Cups, a networking organization for entrepreneurs. He is also a mentor in economic empowerment for IgniteU New York, a group that promotes entrepreneurships and startup businesses throughout central and upstate New York.

Verdicts/Settlements (Case Results):
  • Our client was sued for a variety of causes of action based upon the re-organization via merger of two companies and his role and CEO and Director of both entities.  All causes of action except one were dismissed on a motion to dismiss and we look forward to litigating the final issue at trial., 2017
  • After two years of litigating a FINRA arbitration against our client, the case with dismissed and our client was awarded all attorney's fees and costs - a rare feat in the FINRA context., 2017
  • Our client was sued for negligence arising out of construction work performed.  After initial discovery, we moved and were awarded summary judgment dismissing the case., 2017
  • After three days of hearing testimony, The Wagoner Firm obtained a favorable award on behalf of their client in a $2 million arbitration of a securities-related matter.  Our client built a successful financial advisement company over nearly 30 years.  When the time came to retire, he executed a contract to sell his book of business and the industry relationships that he established over his long career.  Those assets, relationships, and customers were transferred, but the opposing contracting party did not pay for the benefits of the bargain it received.  As a result, our client demanded arbitration on his breach of contract claim, and after a three-day trial, which included several witnesses and countless financial documents, an award was rendered in his favor., 2017
  • Our client was sued for breach of contract by a foreign party relative to its aviation business.  Our motion to dismiss the case was granted and we were awarded attorneys' fees and costs based upon the frivolity of the case.  A rare feat in civil litigation when a contract or statute does not provide for attorneys' fees., 2017
