Verdicts and Settlements:

  • Successful representation of frozen yogurt franchisor against claims that franchise sales process violated the Wisconsin Franchise Investment Law.  Succeeded on motion to dismiss for failure to state a claim. On appeal, the Fifth Circuit Court of Appeal affirmed dismissal holding that there had been no violation of the law., 2016
  • Sucessfully represented franchisee in defense of trademark infringement action instituted by former franchisor.  Three-day bench trial resulted in defense verdict and award for reimbursement of attorneys' fees., 2015
  • Successfully represented franchisee in first case to hold that the Servicemembers Civil Relief Act (SCRA) applies to termination of commercial leases, and of the few cases holding that the SCRA provides a remedy for civil litigants (cited by Congreesional Committees as support for passage of the Veterans' Benefits Act of 2010 which, among other things, clarifies a private right of action under the SCRA)., 2009
