J. Elliott Walthall

A founding member of Frohsin Barger & Walthall, J. Elliott Walthall focuses his practice primarily on the representation of whistleblowers who are pursuing qui tam claims under the federal False Claims Act. Working out of the firm's main office in Birmingham, Alabama, he assists clients throughout the state. Admitted to practice in Alabama since 2007, Mr. Walthall is also admitted to practice before the U.S. District Courts for the Northern, Middle and Southern Districts of Alabama as well as before the U.S. Court of Appeals for the 11th Circuit. He has additionally appeared pro hac vice in federal courts across the country.

The False Claims Act dates back to the 1860s, when it was signed into law by President Lincoln. Since that time, it has been used to penalize contractors who defraud federal government programs, and its qui tam provision allows people who have become aware of such conduct to file claims on behalf of the government and to receive a portion of any damages that are recovered. The types of cases that Mr. Walthall has worked on have involved Medicare hospice fraud, military contracts and other types of government procurement, medical devices, and ambulance transport. He has been able to obtain millions of dollars in awards through negotiated settlements for his whistleblower clients.

In addition to his qui tam practice, Mr. Walthall has extensive criminal defense experience, including wire fraud, embezzlement and other types of white collar offenses. His successful track record has earned him a great deal of recognition from his colleagues, including being named by Birmingham magazine to its annual "Top Attorneys" list. He is a graduate of The University of Alabama School of Law, where he served on the Alabama Law Review before being awarded his Juris Doctor in 2007.
