Patrick Mahaney is a criminal defense attorney located in Montgomery, Alabama, concentrating his practice in defense of driving under the influence (DUI), serious traffic offenses, traffic homicide and traffic assault cases, drug possession/controlled substances violations, and driver license issues. Mr. Mahaney established his law office in July 2006 after completing five and half years of overseas service for the United States government. Mr. Mahaney has been licensed to practice law for over thirty-seven (37) years.
Prior to establishing his law practice, Mr. Mahaney served twenty-two years as a state trooper with the Alabama Department of Public Safety (1978-2000), including duty in uniform patrol, criminal investigations, and as assistant legal counsel for the Department. He served as a special assistant Attorney General for the state of Alabama from 1991-1999. After retirement from state service, Mr. Mahaney served overseas with the U.S. State Department’s civilian police operations in Kosovo, Jordan, and Iraq, including 18 months in Iraq as the deputy commander of the U.S. police mission.
In addition to Mr. Mahaney’s state police service, Mr. Mahaney served twenty-eight years in the United States Army, including four years Regular Army and twenty-four years in the Army National Guard and U.S. Army Reserve. He retired from the U.S. Army Reserve in 2001 as a lieutenant colonel after 28 years of military service.
Mr. Mahaney received his B.A. degree from The Citadel in Charleston, S.C. (1973) and his law degree from Jones School of Law in Montgomery, Alabama (1988). He is licensed to practice law in all Alabama courts and the Alabama Supreme Court, the U.S. District Court, the 11th Circuit Court of Appeals, and the U.S. Supreme Court.
Mr. Mahaney has represented well over two thousand five hundred clients in state and federal court throughout Alabama charged with DUI, serious traffic offenses, and related felony and misdemeanor criminal violations. Mr. Mahaney is the editor and co-author of the widely recognized treatise Alabama DUI Defense: The Law and Practice, 5th Edition, published by Lawyers & Judges Publishing Company, Inc. Additionally, Mr. Mahaney currently serves as state delegate for the National College for DUI Defense. He is a frequent lecturer and trainer in the area of DUI law and criminal procedure and is widely regarded as an "expert" in Alabama DUI law and practice. Over the past decade, Mr. Mahaney has completed a number of advanced level training courses to gain greater proficiency in DUI defense, to include completion of the NCDD 'Serious Science' five-day course in forensic science and trial techniques, the Axion Analytical Laboratory & Training Institute five day course in forensic chromatography (twice), and the Impaired Driving Associates advanced-level training in field sobriety testing.
