Verdicts/Settlements

  • At 1:51 a.m. August 19, 2013 a car with five young adults drove over a private ungated railroad crossing south of Fresno, California, and was hit by a freight train.  Four died and the survivor suffered a TBI and orthopedic injuries. Three wrongful death cases went to trial in the Fresno County Superior Court on January 9, 2017, with claims that the Union Pacific Railroad was negligent regarding the signage and crossing configuration, and that the adjoining landowner “made a dangerous crossing more dangerous” by tampering with the signage at the crossing.  The plaintiffs asked the jury for $29,000,000. On February 8, 2017, the jury returned a verdict for the defense that the UP Railroad was Not Negligent (11–1), that the adjoining landowner, Zim Industries, Inc., was Not Negligent (12–0), and that the driver of the car, one of the decedents, was 100 percent at fault for the collision. Counsel for Defendant Zim Industries, Inc., included DRI member Charles H. Horn, a partner in the San Francisco office of LeClairRyan.
