Ms. Erhardt concentrates her practice on real estate litigation, including disputes between: investors and developers; owners and property managers; sellers and purchasers; landlords and tenants; and principals and agents. She has litigated a wide range of cases involving raw land, food storage warehouses, retail space, restaurants, bars and night clubs, single family dwellings, dairy farms, mobile home parks, gas stations, high rise apartments and commercial office buildings.  

She has represented clients in co-owner disputes involving quiet title, partition and accounting, and neighbor disputes ranging from nuisance and trespass, to prescriptive easements to wrongful excavation and failure of lateral subjacent support.  

Ms. Erhardt has prosecuted and defended countless commercial and residential lease disputes including TIs, CAMs, nonpayment of rent, use violations, assignment & subletting, and failure to replenish letters of credit.  She has litigated multiple real property torts including wrongful eviction, breach of covenant of quiet enjoyment, nuisance and waste and environmental claims involving mold, lead, asbestos and USTs.

She represents sellers and buyers of commercial and residential real property at every stage of the transaction, conducts lease negotiations for commercial and residential landlords and commercial tenants, provides counsel to property management companies, and assists clients with zoning and land use matters.

Ms. Erhardt has prosecuted and defended real estate related Business & Professions Code claims regarding breach of fiduciary duty, actual and constructive fraud, and professional negligence involving architects, contractors, and real estate agents and brokers.  

Ms. Erhardt conducts real estate training seminars, makes presentations to real estate brokers and their agents, publishes articles and participates as a guest panelist on local and statewide radio programs as an authority on real estate matters.  She is recognized as one of the top San Francisco landlord-tenant attorneys in Robert Kiyosaki’s 2009 book, the Real Book of Real Estate (p. 196-197).  Additionally, Ms. Erhardt is the author of the introductory chapter, “Creation and Recognition of Domestic Partnership Regimes in California,” in the CEB legal treatise California Domestic Partnerships.  She has served on the panel of several real estate related continuing legal education seminars.  She frequently co-counsels with family law and trust and estate attorneys seeking real estate related litigation support. 

Before launching her own business, Ms. Erhardt spent two years as a partner at Rutan & Tucker, LLP and seven years as a partner at Sideman & Bancroft, LLP.  

Ms. Erhardt is licensed to practice in California, Maryland and the District of Columbia.  She litigates in both state and federal courts and has extensive mediation and arbitration experience.  She graduated with a Juris Doctor from the University of North Carolina School of Law in May 1997.  She graduated with a Bachelor of Arts from University of Richmond, Westhampton College in May 1991 with majors in English & Philosophy.  She played NCAA Division I Field Hockey for four years and attended Olympic Development Camp.
