- I authored Chapter 6 of this book. The Chapter is entitled "Standards Essential Patent Portfolio Development. "Technical standards, particularly for information and communications technology (ICT) industries, require use of patented technologies, as reflected by continuing growth in Wi-Fi and cellular standards. This trend will only increase as new or next-generation standards are developed for the Internet of Things, and yet unforeseen applications. Understanding issues relating to the use of patented technologies in technical standards is more important now for patent practitioners than ever before. Patent prosecutors can use this book to understand the standard process and advise clients on strategies for patent preparation, prosecution, and portfolio development in the standards area. Patent litigators can use this book to understand the unique issues regarding enforcement of standards-essential patents (SEPs). In-house counsel who want to build more valuable SEP portfolios can use this book to develop portfolios, create effective licensing programs, and manage outside counsel. Part I looks at the history, organizations, and policy considerations involved in setting standards. Part II offers best practices for patent prosecution and portfolio development for standards-related technology, including interfacing with engineers, portfolio development, preparation of SEPs, claiming strategies, and prosecution in the U.S. and other countries.
