  • Mr. Garcia discussed how a thorough investigation of a work accident can sometimes lead to the identity of a potentially liable third party. For example, when an employee is injured on a construction site, on another’s premises, in a fight, in an automobile accident, or as a result of a defective product or piece of machinery, someone other than the employer may be legally responsible for the employee’s injuries. If a third party case exists, an employer can benefit from seeking the assistance of a Plaintiffs’ attorney as such a scenario will allow the employer to potentially recoup some of the monies it paid to the claimant, with no additional risk being born by the employer. The employees themselves will also benefit as they will be able seek compensation which is not available in the workers’ compensation arena.   • Sandoval vs. Summit Care Corporation (Fresno Superior Court case No. 633197-9) - Trial counsel for plaintiff in which the plaintiff received a compensatory award of $2.4 Million. The matter was settled for a confidential amount just prior to the opening statements for the punitive damage phase.  Radle vs. Confidential  Plaintiff's counsel - case settled for $3.15 Million. Castellanos vs. Confidential - Plaintiff's trial counsel - case settled for over $2.2 Million during trial. McCarron vs. Confidential - Plaintiff's counsel - case settled for $750,000.Anderson vs. Confidential - Plaintiff's counsel - case settled for over $750,000.  Garcia v. confidential - person bit by dog on two separate occasions which settled for $750,000.  Ransom v. Confidential - Slip and fall which settled for $750,000.   
  • Defendant tendered policy limits for a client was in a motor vehicle accident and sustained back injuries.  This case was significant given Plaintiff's significant back history, including 20 year history of back pain and epidural injections, 2014
  • Person v. Utility Company settled for $225,000, 2014
  • Obtained a $380,000 settlement for a landscaper who was bit by an property owner's dog., 2017
  • Obtained a verdict of $676,000 for a client involved in a low speed rear end collision.  Plaintiff's medical specials were $21,000.  Defendant's pre-trial settlement offer was $55,000.  Plaintiff's pre-trial settlement offer was $200,000., 2018
  • $300,000 (policy limit) for a woman who was injured when a rolling gate on another person's property fell over on top of her, causing her to be injured., 2018

  • Patient v. Health Care Provider settled for $1,500,000, 2014

  • Myself, along with partner Brian J.
