    Representative Clients:

    • Simon Etehad obtained a favorable appeal and a subsequent Order vacating an arbitral award. Specifically, when the Arbitrators refused to award disgorgement under Business and Professions Code Section 7031, the odds were stacked against Mr. Etehad and his client. Not only did Mr. Etehad have to overcome the Supreme Court’s ruling that an “arbitrator’s decision cannot be reviewed for errors of fact or law” (Moncharsh v. Heily & Blase (1992) 3 Cal. 4th 1, 11), but he also had to convince the Court of Appeal that the Defendant was acting as an unlicensed contractor. The results obtained were exemplary: the Court of Appeal made new law and clarified existing law, holding that “section 7031 constitutes an explicit legislative expression of public policy regarding unlicensed contractors,” rendering inapplicable the general prohibition of reviewing arbitration awards announced in Moncharsh. (Ahdout v. Hekmatjah (2013) 213 Cal.App.4th 21, 38.) In obtaining a published opinion extending the protection of section 7031, and having expended thousands of hours on this case, Mr. Etehad advocated for “a higher interest — that of the public, whose welfare demands that certain transactions be discouraged.” (Franklin v. Nat C. Goldstone Agency (1949) 33 Cal.2d 628, 632.) Mr. Etehad thereby “conferred a significant benefit upon a large class of persons.” (CCP § 1021.5.) The ramifications of the case were summed up by one commentator as follows: “Bottom Line: Pay attention to state licensing laws, or you risk losing in court and in arbitration.” The matter finally settled by virtue of a binding arbitration award in 2021.
