Verdicts and Settlements:

  • NASD Arbitration: $3,000,000.00.  Labor Code 970 Claim.  The award included $1.65 MM in monies received by virtue of voided promissory notes.  The award represented one of the largest such awards in NASD/FINRA history
  • Disability Harassment Case (Parties Confidential):  $1,085,000.00
  • Avila v. Guardia Bros, Inc., et al.:  $2,001,241.66 (Sexual Harassment Case) 
  • Kimberly Carbone and Robert Perez v. Ontario Cemetary Association,at al.:  $2,999,964.55, including an award of $562,000 for statutory attorneys fees and costs.  (FEHA Retaliation)
  • Doe 1, et al. v. ABC Corporation- $6,500,000 settlement in a sexual harassment/invasion of privacy case in San Bernardino, California.  Employees from a manufacturing company sued their employer when they discovered a surveillance device had been placed in the workplace restroom.  Plaintiffs sought emotional distress damages and punitive damages.  Defendants alleged that the device was placed in the restroom by a co-worker without their knowledge or ratification, absolving the employer of liability.  Plaintiffs contended that the offender was a de facto supervisor, subjecting the company to strict liability.  Defendant brought a Motion for Summary Judgement, which was denied.  After the parties engaged in more than 60 depositions, the matter settled for $6,500,000 during a two day private mediation.
  • Doe 1 v.  XYZ Corp.:  $1,150,000 settlement in a retaliation case in Riverside, California.  Plaintiff alleged that her employer unlawfully subjected her to disciplinary in the form of a five-day unpaid suspension in retaliation for bringing a discrimination lawsuit two years earlier.  Plaintiff further alleged that the disciplinary action resulted in a constructive termination.  Defendants alleged that Plaintiff was not actually or constructively terminated, and that her suspension was justified by the company’s well-documented attendance policy.  Plaintiff claimed lost wages damages in the amount of $250,000 and emotional distress damages.  Defendant initially offered $25,000 to settle the matter prior to litigation.  Defendant brought a Motion for Summary Judgement, which was denied.  The case settled for $1,150,000 in private mediation less than 60 days before trial.
