Plaintiffs sought emotional distress damages and punitive damages. Defendants alleged that the device was placed in the restroom by a co-worker without their knowledge or ratification, absolving the employer of liability. Plaintiffs contended that the offender was a de facto supervisor, subjecting the company to strict liability. Defendant brought a Motion for Summary Judgement, which was denied. After the parties engaged in more than 60 depositions, the matter settled for $6,500,000 during a two day private mediation.
