Represented Food Distributor in multi-million dollar federal district court lawsuit, involving 23 rail cars of white corn purchased for resale to Hispanic stores to make tamales. A major Hispanic store group experienced catastrophic customer tamale returns on the eve of Christmas, which brought significant negative TV publicity. We defended the Food Distributor and brought a third-party complaint against the Nebraska Grain Elevator, one of the largest grain distributors in North America.  We investigated causation and developed significant proof that the cause of the tamale failure was the Grain Elevator's sale of white corn that had been contaminated with a new-type of GMO corn created for the ethanol industry, not food use.  After defeating a motion for summary judgment, the case was when jury trial preparation was substantially complete. Settlement terms are highly confidential., 2018
