  • We resolved a personal injury case for an LAPD motorcycle officer with a traumatic brain injury from an on-duty accident with an elderly man who was drunk.  He also suffered numerous orthopedic injuries requiring surgery. Although the defendant carried only a $100,000 auto insurance liability limit, we settled the case at mediation for $395,000, after convincing the defendant to sell a rental property to come up with additional funds to resolve the claim. We also settled the officer's underlying workers' comp. claim for 78% permanent disability, and he eventually returned to work at permanent light duty, 2015
  • Settled a personal injury case involving an LAPD Sergeant injured on duty in a traffic collision, who sustained a mild traumatic brain injury due to a rollover accident, and was left unable to return to work.  Although there was a bodily injury insurance liability limit of $1 Million, only about $700,000 remained available on this "burning limits" policy, out of which another claimant was also paid, and defense costs and fees were deducted.   We nevertheless obtained an "excess" settlement of $1.25 Million, since we "opened up the policy limit" to exposure beyond the $1,000,000.  The settlement included disposing of a workers' compensation lien of about $175,000, with a "waiver" of credit against future workers' compensation benefits for this same injured officer, 2013
