  • Mr. Garcia discussed how a thorough investigation of a work accident can sometimes lead to the identity of a potentially liable third party. For example, when an employee is injured on a construction site, on another’s premises, in a fight, in an automobile accident, or as a result of a defective product or piece of machinery, someone other than the employer may be legally responsible for the employee’s injuries.   • $16,500,000 Settlement for a Civil Rights action brought against the Los Angeles County Sheriff's Department ("LASD").     On July 26, 2019, Plaintiff Timothy Neal was suffering from a mental health crisis, for which Plaintiff Barbara Neal sought assistance from the LASD.  Defendants Sergeant Travis Kelly, Deputy Trainee Connor Hoffman, and Deputy Ian Walker responded to the Neal residence.  When the LASD deputies responded to the scene, Mr. Neal was locked inside his bedroom.  The deputies were aware that Mr. Neal’s bedroom contained a kitchenette, and that there would be knives inside the kitchen.  After unsuccessfully attempting to persuade Mr. Neal to voluntarily leave his bedroom, Defendant Kelly decided to make forcible entry into Mr. Neal’s bedroom by using a sledgehammer to break down the bedroom door.  At no point during this process did Mr. Neal make any threats towards the deputies, himself, or anyone else.  As the deputies were in the process of breaking down the door, panels of the bedroom door broke free, allowing the deputies to see inside the bedroom.  From outside the bedroom door, Defendant Hoffman observed Mr. Neal moving around the bedroom with knives in his hand, and he conveyed this information to the other deputies.  The deputies ultimately entered the bedroom and found Mr. Neal standing in the opposite corner of the bedroom, approximately 23 feet away from the deputies and separated by furniture that created a barricade, holding two knives in his hands.  Defendant Hoffman breached the barricade and moved toward the bathroom adjacent to the bedroom.  LASD Deputy Holm fired his Taser at Mr. Neal from across the room, causing Mr. Neal to scream and run away from the deputies, toward the kitchenette.  As Mr. Neal was running toward the kitchenette, Defendant Hoffman fired his lethal firearm at Mr. Neal, missing him.  LASD Deputy Zimmerman fired her Taser at Mr. Neal but also missed him.  As Mr. Neal continued to run away from the deputies, Defendant Walker fired his lethal firearm at Mr. Neal, striking him in the back.  Mr. Neal collapsed to the floor.  Mr. Neal was airlifted to the hospital, where medical professionals determined that Mr. Neal had suffered a thoracic spinal cord injury, which could not be surgically repaired, and Mr. Neal was permanently paralyzed from the chest down.  , 2022
