  • $2,500,000 settlement, Escobar v. Asplundh Tree Expert Co., Los Angeles County Superior Court (Norwalk). The plaintiff, a Sheriff's deputy was traveling in the middle of the roadway on a busy street with high traffic while responding to a Code 3 call.  He swerved to avoid a tree trimmer moving into a left turn lane in front of him. The plaintiff lost control of his vehicle and hit a building. He suffered cervical sprain/strain that fully resolved, as well as a brain injury. The brain injury was highly disputed because the plaintiff returned to full duty with no restrictions after some months and continued working with no restrictions for several years before a 3rd party lawsuit was filed. Liability was also disputed because the defendant driver contended that the plaintiff was not wearing his seatbelt and did not have his lights or sirens on at the time of the incident. The case was venued in Norwalk, an extremely conservative jurisdiction. Before expert depositions started, the defense refused to offer more than $750,000 to settle the case. I took and defended all of the expert depositions. The case settled for $2,500,000 shortly before expert depositions were completed, a little over a week before trial., 2018
  • 1,000,000 settlement, Hernandez v. Ramirez (rear-end crash), San Diego County Superior Court. My client suffered cervical sprain/strain and lumbar injury. The defense argued that all of my client's complaints arose from pre-existing, degenerative conditions. I argued that his degenerative spine had been asymptomatic prior to the collision and was aggravated into being symptomatic due to the collision. The plaintiff underwent a novel fusion surgery within months of the crash, but continued to have pain; another, more traditional fusion surgery was subsequently performed, and he continued to have pain. He finally underwent epidurals and a facet block that relieved much of his pain; the defense argued that these treatments should have been performed prior to the surgeries. The defense also argued that my client - a truck driver - had failed to mitigate his loss of earnings because he had only sporadically sought out work in any capacity during the pendency of the litigation. The case was venued in San Diego and settled a few weeks before trial., 2018
