The Defendants argued that the extensive injuries that the Plaintiff had suffered from were in fact pre-existing; he had been treating his lower back for the previous 4 years. In an ingenious response, the staff recovered surveillance tape of the Plaintiff going about his daily activities including carrying heavy materials and undergoing physical labor.
