Brent Kaspar is the founding and managing partner of Kaspar & Lugay LLP in Corte Madera, California.   • Starting September 1, 2024, the child support landscape in California will change substantially for the first time in more than three decades. WHAT’S GOING ON? In 2016, the Office of Child Support Services published a report that confirmed California was out of compliance with certain federal mandates regarding the establishment and enforcement of child support orders. As a result, in 2023, California passed Senate Bill 343 to address these shortcomings and modernize our child support laws to ensure continued and increased federal funding of our local child support enforcement agencies. WHY DOES IT MATTER? In short, two very significant changes will occur on September 1, 2024: First and foremost, the underlying calculation for child support will change. This will affect two primary groups: Those making under $5,000.00 per month in gross monthly income, and those making over $10,000.00 per month in gross monthly income. This calculation update can change the amount of child support you pay or are paid under the California guidelines. The Court has also changed the way that child support add-ons (unreimbursed health care costs and childcare costs) are handled. Previously, it was presumed that the Parties would share equally these costs, subject to the Court’s discretion to allocate under Family Code Section 4061. Under the new guidelines, it is presumed that the Parties will pay these costs in proportion to their net incomes after taxes. This means that you may pay a greater or lesser share of these expenses under new guidelines. HOW DO I RESPOND? With these changes we recommend that you review your current child support order to understand if it may be impacted and, if so, identify the appropriate actions to take based on your individual situation., "The Changing Child Support Landscape”
