Attorney Profile

Attorney William R. Cumming founded Cumming & Associates, APLC, to offer businesses and individuals in California with representation and advocacy backed by more than two decades of experience. With the goal of providing high-quality, client-focused service, Bill handles litigation disputes in a variety of areas, corporate transactional matters, real estate, estate planning, and bankruptcy. 

After receiving his Bachelor of Arts degree in economics and political science from the University of California, Los Angeles, Bill spent some time in Japan teaching English. He returned to the U.S. and earned his Juris Doctor from Loyola Law School in 1998.

Bill is admitted to practice in all state courts, as well as before the U.S. District Court for the Central District of California, the U.S. District Court for the Eastern District of California, the U.S. District Court for the Northern District of California, the U.S. District Court for the Southern District of California and the U.S. Court of Appeals for the 9th Circuit.

Bill frequently shares his knowledge of real estate, litigation, and bankruptcy matters to professional organizations. He has also served as an adjunct law professor at Trinity Law School. He is a member of several bar associations, including the Orange County Chapter of the Federal Bar Association, the American Bar Association and the Orange County Bar Association, and the Association of Business Trial Lawyers. He has his real estate broker's license, and he has also obtained his pilot’s license.

Verdicts/Settlements

  • Represented an employer who hired two people as independent contractors. A lawsuit was filed alleging misclassification of their employment status, PAGA violations, and other various employment claims. The parties reached a confidential settlement before trial, 2020
  • Prevailed on a motion for summary judgment relating a dispute between the parties as to whether the money the defendants invested was considered a loan or investment and whether the repayment to the defendants was at a usuary interest rate. , 2022
  • Represented the plaintiff real to a real property dispute relating to who was the correct owner. The parties settled shortly before trial for a confidential amount, 2018
  • Bill Cumming was retained to represent a defendant in a lawsuit filed in the Orange County Superior Court relating to whether the defendant improperly obtained money from another business while he was employed by the plaintiff who was his prior employer. The plaintiff was demanding $200,000 in damages. A letter was sent to the plaintiff's counsel explaining the weakness of the case. The parties settled for a nominal amount and avoided the time and expense of litigation, 2020
  • Represented an individual as a defendant who was sued for breach of contract relating to the purchase and sale of a business. The client was the defendant. We argued the contract at issue was not between the plaintiff and the individual defendant, but rather the plaintiff and the corporate defendant. We file a motion for summary judgment and it was granted it is entirety, 2019
  • Bill Cumming was retained to represent the plaintiff in two separate lawsuits relating to a derivative action and a dissolution action. The two cases were consolidated. The case related to a business dispute between two parties and whether the defendant improperly started a new company to compete with an existing company the parties owned together. Shortly before trial, the parties reached a confidential settlement after a 15 hour mediation, 2018
  • Bill Cumming was retained to represent defendant Juny Campos in a case entitled Aracelia Aguilar-Garcia v. Juny Camps filed in the Superior Court of the State of California, County of Riverside. The case related to whether the plaintiff was entitled to have an ownership interest in a house located in Riverside County. After a 14 day bench trial, the court issued a defense verdict and awarded the defendant approximately $80,000 in attorney's fees and costs, 2018
  • Bill Cumming represented plaintiff Cynthia Daniel in an adversary action filed in the United States Bankruptcy Court Central District of California entitled Cynthia Daniel v. Jose Del Valle, Adversary Case No. 6:10-ap-01361-MJ. After a 10-day bench trial, the court issued a memorandum of decision holding that defendant Jose Del Valle engaged in fraudulent conduct relating to a real estate Ponzi scheme, and a judgment was entered against Jose Del Valle for $1,136,321, 2017
