The settlement also provided for the payment by defendant Moulton Niguel Water District (MNWD) of $2,700,000 in attorneys’ fees and a permanent injunction prohibiting the wrongful conduct in the future. After 3 years of litigation we obtained a favorable jury verdict in the amount of $5,909,554 in damages. The jury also elected to award punitive damages and there is a punitive damages trial set for early January 2024. This case involved a conversion action arising out of the theft of funds from a chemical company in Buena Park, CA. This settlement was achieved within three months of the employee’s wrongful termination, and just before suit was to be filed. The lawsuit would have named a world-renowned Olympic athlete, among others. The employee was employed by the Defendant companies for over fourteen years, and held an executive position. The employee helped develop the companies, and devoted much of her time to her position. The employee initially began a romantic relationship with her immediate supervisor, but attempted to end the relationship soon after it started. The immediate supervisor reacted by telling the employee that, if the relationship ended, she would no longer be able to work for the companies. When the employee did end the relationship, she was subjected to a hostile work environment by her immediate supervisor. After the employee ended the relationship, she was repeatedly told that her position was not in jeopardy, and that she would not be terminated. The employee, however, was terminated without warning and without cause. She was offered a six-month severance package. When the employee hired Gregory G. Brown to review the severance package, as advised in writing, the Defendants became hostile and ceased negotiations. The parties attended mediation, but initially did not reach a resolution. Throughout the following three weeks, the attorneys negotiated vigorously, sometimes on weekends and nights. Negotiations eventually stalled. Faced with the immediate threat of a lawsuit, however, Defendants quickly settled. The possible lawsuit was premised on wrongful termination in violation of public policy, hostile work environment, sexual harassment, breach of implied-in-fact employment contract, defamation, and intentional infliction of emotional distress. Mr. Brown strongly negotiated with the opposing counsel for over three weeks to substantially increase the initial settlement offer, resulting in a six-figure award. , 2011
Gretchen Rossi prevails in her 3½-year legal battle with Jay Photoglou. A jury awarded Rossi $523,250 on her stalking and assault lawsuit and found against Photoglou on his defamation claims against Rossi. The jury also found Photoglou liable for “malice, oppression, and fraud,” and assessed rare “punitive damages” to punish him for his intentional conduct designed to harm Rossi. During the punitive damage phase of the trial, which is designed to determine the wrongdoers net worth (to determine amount of punitive damages), Photoglou’s June 28, 2012 Bankruptcy Filing took center stage, according to the transcripts. Notable was the $334,000 owed to the IRS and other Governmental Entities. The total debts listed in the Bankruptcy filings (used to limit the amount of punitive damages) amounted to $902,299.80, according to the trial exhibit. The total assets listed were $25,256. Of note is the fact that Photoglou claimed he had $23,250 of photos of Rossi (this amount listed as exempt from creditors and also the amount the jury found in punitive damages against Photoglou, according to the jury verdict).
