- Jury Verdict $750,000 | Van vs. Auto Facts & AllegationsOn Aug. 3, 2015, plaintiff Angelica Hermosillo, 19, a medical assistant, was a passenger in a vehicle operated by her sister traveling in Bakersfield. The vehicle Hermosillo was in was subsequently rear-ended by a vehicle operated by Brent Christopher Robinson.Hermosillo sustained injuries to her back and leg.Hermosillo sued Robinson, as well as Kevin Wood, whom Robinson was in the course and scope of his employment with at the time of the collision. Hermosillo's counsel contended that Robinson was negligent in the operation of his vehicle and that Wood was vicariously liable for Robinson's actions. Defendants initially contended that Hermosillo's sister cut off Robinson's vehicle prior to the collision, but defendants ultimately admitted liability for the collision on the eve of trial. Injuries/DamagesBulging disc, lumbar; back; radicular pain / radiculitis; legHermosillo developed low back and leg pain. She sought treatment at an emergency department 17 days after the accident. She sustained a 10 mm bulge at L5-S1. Hermosillo claimed the bulge caused the radicular pain into her leg. Eight months after the collision, Hermosillo underwent an L5-S1 surgery. She did not receive any medical care for the four years after the surgery. Plaintiff's expert in neurosurgery recommended that Hermosillo would need a future surgery at the adjacent level.Plaintiff's counsel noted that defense's expert in neurosurgery admitted on the stand that Hermosillo required the L5-S1 surgery after the collision and deferred to plaintiff's neurosurgeon on future care recommendations. Hermosillo sought recovery for her past and future pain and suffering and past and future medical costs.Defendants disputed causation and nature and extent of injuries.On plaintiff counsels' motion, the court excluded defendant's biomechanical expert from testifying at all. His expected testimony was that that collision could not have caused the injuries alleged to Hermosillo's spine. - The firm’s client, Jacqueline, was pregnant and driving her employer’s vehicle North on Fremont Avenue. As she entered the San Bernardino Street intersection on a green signal, an Omnitrans bus driven by Jack Oliver failed to yield the right of way and ran a red light traveling West on San Bernardino Street and slammed into Jacqueline's vehicle. After the accident Omnitrans went on KCAL 9 News and represented that Jacqueline Andrade had run the red light and collided with the bus. The client retained the law firm of Akiva Niamehr, and from there the firm promptly uncovered the camera footage from the bus and filed suit against Omnitrans and its driver, Jack Oliver, for personal injuries Ms. Andrade sustained in the accident. Video from the dash and inside cameras of the bus showed that Jack Oliver, the bus driver, had run a red light, and that the police and Omnitrans knew that Mr. Oliver ran the red light through their review of that footage within minutes of the crash. According to documents filed with the court, Omnitrans initially denied Jacqueline Andrade's claims on the basis that Ms. Andrade was negligent and failed to exercise ordinary care. However, by interviewing and deposing multiple witnesses and obtaining testimony from Mr. Oliver that Omnitrans had found that Mr. Oliver could have prevented the accident, Laura Lynn Davidson and her team pieced together a compelling case against Omnitrans resulting in Omnitrans stipulating that they were liable for their employee's negligence, which caused the accident. Shortly before the scheduled jury trial when it became clear that the Akiva Niamehr legal team was not backing down from its demands and was ready for trial, defense counsel finally initiated meaningful settlement negotiations and the case settled for $1,500,000.00.Ms. Davidson said that, “although the defendants initially claimed that they were not liable, we remained firm in our position throughout the case and were diligent throughout the discovery process, while we prepared rigorously for trial. The confidence we projected through our unwavering stance and the thorough preparations we made for trial sent a clear message to the defendants that we meant business, and we feel that is ultimately what made them come to the table with such a significant settlement offer. - On October 19, 2015, an Imperial County Superior Court jury in El Centro, California awarded $5.1 million to a woman who suffered serious orthopedic injuries after the vehicle she was driving collided with a commercial truck that had illegally crossed into her lane. The plaintiff was represented at trial by Brian Panish, Thomas Schultz, Spencer Lucas and Erika Contreras of Panish Shea & Boyle LLP. The plaintiff was also represented in the case by Laura Lynn Davidson and Jubin J. Niamehr of Akiva Niamehr LLP. On December 6, 2013, a truck driver working for Joe Heger Farms, LLC was operating a commercial flatbed truck fully loaded with nearly 20,000 pounds of chicken pellets. Elvia Gomez Gonzalez, age 59 at the time, was driving her 2009 Nissan Versa northbound on Ferrell Road when the truck, which was traveling southbound, crossed into the northbound lane to begin making an improper left turn. Mrs. Gonzalez attempted to avoid a collision with the truck but was unable to do so due to its size. As a result of the collision, Mrs. Gonzalez suffered significant injuries including a pelvic fracture, a fractured left leg and ankle, and transverse fractures of the spine. She has undergone three major surgeries including a total hip replacement. Once an active member of her community, the accident has left Mrs. Gonzalez with serious physical limitations and unable to return to work. At trial, the defense contended that the damages being requested by Mrs. Gonzalez were excessive and argued that Mrs. Gonzalez was not as seriously injured as she claimed, that she had substantially recovered and that she would not have lifelong complaints relating to her injuries. The jury disagreed and awarded Mrs. Gonzalez $5,138,260 including $477,817 for past economic losses, $1,410,543 for future economic losses, and $3,250,0000 for past and future pain and suffering. Defendants were represented at trial by Paul Kissel and Jonathan Geen of Borton Petrini LLP. At the time, this was believed to be the second largest personal injury jury verdict in Imperial County history., 2015
