- In this high-stakes medical malpractice jury trial, Richard D. Carroll served as lead defense counsel representing a pain management and anesthesiology specialist. The plaintiff alleged medical negligence and lack of informed consent following a cervical epidural steroid injection, which resulted in a severe spinal cord hematoma and permanent quadriplegia/paralysis. The plaintiff sought over $30 million in general damages, lifetime future medical and custodial care costs, and loss of earning capacity. Mr. Carroll successfully demonstrated that the physician adhered strictly to the standard of care in injection technique, patient monitoring, and risk disclosure, and established that the neurological outcome was an extremely rare, non-negligent complication.
