He also authored and argued appeals before the 9th Circuit Court of Appeals, achieving reversals in numerous cases.
After his tenure as a trial lawyer, Mr. Khojayan joined the prominent plaintiff's class action law firm, Milberg Coleman Bryson Phillips Grossman, PLLC, where he litigated securities class action lawsuits. Within the firm, he was also part of a select group of attorneys responsible for complex shareholder lawsuits related to mergers and acquisitions. - Acquittals on 9 counts and convicted on only 2 counts in a Federal Bench trial in a visa fraud conspiracy involving fake transcripts and applications that resulted in the issuance of immigration documents (I-120s) to enter the United States. The defense was that the fake applications and transcripts were only to get offers of admission into U.S. universities, not to cause immigration documents to issue. The court found the client not guilty on 9 counts including the conspiracy count. The two counts of conviction resulted in several years less time than proposed by the government before trial. Specifically, because of this defense strategy and acquittals, the court’s sentencing of the client included one immigration document as opposed to the over 250 immigration documents the government had sought, 2022
- Not guilty jury verdict in a federal multi-defendant case involving conspiracy to distribute marijuana, importation of marijuana, and possession with intent to distribute 4,085 lbs of marijuana. Mr. Khojayan raised and argued motions to limit the Government’s case. Mr. Khojayan interviewed witnesses for trial and called them to the witness stand. The Defense was that the defendant was unaware of the contents of the packages that others unloaded. Based on the evidence and Mr. Khojayan’s arguments, the jury found the defendant Not Guilty on all counts. The defendant had been facing a 10 year mandatory minimum sentence.
