- There are two different types of child custody: Legal and Physical. And there’s “Joint” and “Sole” custody for both types. Legal Custody involves decisions that are going to be made by the parents; usually health, education, and welfare. Joint Legal Custody is typically awarded if both parents are shown to be responsible. Physical Custody refers to who the children are living with, and again, either “Joint” or “Sole” custody can be awarded to one or both parents. If the children are primarily living with one parent, that party will have Sole Physical Custody. If the timeshare is closer to 50-50, then the parents will have shared, or Joint Physical Custody. This gets complicated in move-away cases, and there are many factors involved in determining both legal and physical custody. - A minor child does not directly decide which parent they live with, however, they can often have their desires made known to the court. If they are over 13 years of age, this can be done by direct testimony; sometimes the judge will even allow younger children’s testimony to be presented – especially if they are very mature. A second method of getting the child’s desires presented, is by having a representative from Family Court Services relay information gathered during their interview with the child. The last possibility is by the assigning of a Minor’s Counsel – a legal representative of the child(ren) only., Can a Minor Child Decide Which Parent They Live With?, 2015
