- Absent a warrant or probable cause, the fourth amendment right of U.S. citizens is violated when the NSA collects and records telephone calls and metadata (telephone numbers and call durations, times, etc.,) as well as email contents and metadata (email addresses, recipients, send times, etc.,) and uses that information to either charge a citizen with a crime, or if as a result of that information starts suspecting that the citizen is guilty of a crime or conspiracy.
