Kyle A. Withers

A California-based attorney with extensive experience in both federal and state courts, Kyle A. Withers is a partner at the San Francisco firm Lubin Olson & Niewiadomski LLP. Known for his hand in complex commercial litigation, including securities litigation, general business litigation, and real estate litigation, he has litigated a wide variety of disputes involving partnerships, commercial leases, construction defects and delays, securities fraud, and misappropriation of trade secrets. 

Practicing law in California for more than a decade, Mr. Withers has worked on several ground-breaking cases that have been covered and discussed in leading publications, such as The New York Times and The Wall Street Journal. A few of his notable cases are the following:

• Defended a public company against manipulation accusations raised by a prime broker and secured a settlement of $20 million for his client.
• Legally counselled a multifamily property owner based out of Silicon Valley who faced allegations regarding a sale contract and purchase worth over $100 million and successfully obtained a favorable verdict.
• Represented a tech startup against their landlord in a dispute centered around whether the lease was rendered void in accordance with San Francisco zoning laws.

After graduating summa cum laude from Stonehill College with his Bachelor of Arts degree, Mr. Withers attended the New York University School of Law and earned his law degree in 2007. He was first authorized to litigate cases in Massachusetts in 2007 and later, after three years, in California.

Mr. Withers holds active memberships in various professional organizations, such as the Bar Association of San Francisco, the Marin County Bar Association, and the Association of Business Trial Lawyers. Mr. Withers was also formerly a member of the Edward J. McFetridge American Inn of Court.
