Verdicts / Settlements (Case Results)
- Personal Injury / Wrongful Death. Result: Settlement in Excess of $7,000,000.00. Mr. Brown represented the surviving family members of a decedent in a wrongful death action against multiple defendants, where liability was disputed and the damages included the loss of the decedent's financial support and the family's loss of the relationship. The matter was resolved through negotiation before trial. Prior results do not guarantee a similar outcome, and every case is different and depends on its own facts., 2026
- Litigation Victory (Saving Client’s $5 Million Inheritance) Result: Successfully Defended Enforcement of No Contest Clause by Way of Anti-SLAPP Motion Blaine M. Brown was retained by a beneficiary of a $15-$20 million trust after 2 years of litigation with different counsel. Unfortunately, during the past 2 years of litigation, pleadings were filed in multiple counties which the trustee of the trust believed to have violated the no contest clause of the trust. Within weeks of being retained, Mr. Brown was served with a petition to enforce the no contest clause. If the trustee succeeded, his client would be disinherited as a beneficiary of the trust, thereby losing an inheritance in excess of $5 million. In response to the petition to enforce the no contest clause, Mr. Brown strategically filed an anti-SLAPP Motion as his client’s responsive pleading to force the hand of the trustee in putting all of the evidence in support of the petition forward within 60 days for the court to rule on the anti-SLAPP Motion. Ultimately, the court granted Mr. Brown’s anti-SLAPP Motion, resulting in the petition to enforce the no contest clause being stricken and the trustee being ordered to pay all of Mr. Brown’s attorney’s fees and costs., 2024
- Result: Dismissal of Multiple Lawsuits for Fraud, Conversion, Financial Elder Abuse, Breach of Fiduciary Duty, Surcharge, Etc. OC Trial Group’s trust and estates litigation attorneys, Blaine M. Brown and Ryan W. Young successfully defended their client who was a trustee in multiple lawsuits (different counties) filed by a beneficiary. These lawsuits, among other causes of action, alleged that their client was liable for fraud, conversion, financial elder abuse, breach of trust, breach of fiduciary duty, etc. in an amount of approximately $3,000,000 to $5,000,000. Through tactical litigation strategies, Mr. Brown and Mr. Young were able to obtain dismissals of all lawsuits filed against the client., 2023
- Result: $1,500,000 in Financial Elder Abuse Pre-Litigation Blaine M. Brown successfully obtained a pre-litigation settlement for his client in the amount of $1,500,000 to his client and several hundreds of thousands of dollars to his client’s children. His client’s brother had a substantial financial estate which he intended to distribute pursuant to his original plan (30 years before his passing in 2022). As his client’s brother’s health rapidly declined, his client’s niece had a power of attorney executed and completely rearranged the brother’s financial estate to benefit herself and her mother, misappropriating approximately over $700,000. Mr. Brown negotiating on behalf of his client to obtain the aforementioned settlement and helped his client avoid protracted litigation relating to the claim for Financial Elder Abuse., 2023
- Result: Removal of Trustee, Surcharge for Double Damages, and Appointment of Client as Trustee. Blaine M. Brown, Esq. of OC Trial Group, APC, represented a client who was a beneficiary of a family trust. Mr. Brown was able to demonstrate to the court that the trustee should be removed and surcharged for double damages based on the trustee’s breach of fiduciary duty and breach of trust. Mr. Brown also obtained the appointment of his client as trustee of the family trust., 2023
- I represented a beneficiary and co-trustee of an AB Trust in receiving a $1.1 million pre-trial settlement. My client was previously offered $0 during pre-litigation., 2023
- OC Trial Group Successfully Represents Beneficiary in trust disputes, it is important to have an experienced and knowledgeable legal team on your side. OC Trial Group recently represented a beneficiary in a trust dispute and obtained a favorable judgment against the trustee. Our team worked diligently to ensure our client received the compensation and justice they deserved. The first step in our representation was to establish the wrongdoing of the trustee. We were able to provide evidence that the trustee had misappropriated funds and acted wrongfully and in bad faith. This evidence helped us in obtaining a judgment that the trustee was removed from their position and that our client was appointed as trustee in their place. Next, we argued for and were granted double damages under probate code section 859 for the trustee's misappropriation. This compensation was essential in ensuring that our client was able to recover from the financial losses they incurred. We also argued for and were granted prejudgment interest at a rate of 10% per annum. This helped our client to recover from the lost time and opportunity costs they encountered as a result of the trustee's actions. Finally, we obtained a judgment that the trustee was liable for all attorney fees and costs associated with the case. This compensation was important in ensuring that our client did not bear the burden of legal fees in addition to the financial losses they had already suffered. At OC Trial Group, we are dedicated to representing our clients with skill, professionalism, and dedication. Our recent success in representing a beneficiary in a trust dispute highlights our commitment to helping our clients achieve the justice and compensation they deserve. If you are facing a trust dispute, contact our team for a consultation to see how we can help you., 2023
- Personal Injury - Traumatic Brain Injury - Settlement of $1,575,000.00., 2023
- Financial Elder Abuse, Breach of Fiduciary Duty, and Aiding and Abetting Breach of Fiduciary Duty. We represented the Petitioner in protracted litigation for Financial Elder Abuse and Breach of Fiduciary Duty against the Trustee and an agent of the Trust. Following four (4) full days of Trial, we obtained a seven (7) figure settlement on behalf of our Client (over half a million dollars over the Trustee's original offer)., 2022
- My Client's brother had a substantial financial estate which he intended to distribute pursuant to his original plan (30 years before his passing in 2022). As my Client's brother's health rapidly declined, my Client's niece had a power of attorney executed and completely rearranged my Client's brother's financial estate to benefit herself and her mother. Following several demand letters, the financial accounts were corrected to reflect my Client's brother's original intent. At the conclusion, my Client received approximately $1,500,000.00 and each of his children received several hundreds of thousand of dollars., 2022
- Prior to Decedent's passing, she restated her Trust to provide the majority of her estate (approximately $1,500,000.00) solely to my Client and reduce the other siblings to less than $5,000.00 each. Following extensive written discovery and depositions, I obtained a settlement for my Client which provided him approximately 80% of the estate (increase of over 50% of what he was to receive previously). Further, I was able to ensure that my Client was protected from potential defamation by including liquidated damage provisions in the settlement agreement, should any confidentiality be breached., 2022
- This case involved a Preliminary Injunction attempting to block the sale of Trust Property that my Client negotiated, as Trustee. My Client sold a Property for $2,200,000 and the Beneficiary of the Trust, which owned the Property, disputed the sale and tried to block it. The Beneficiary filed an Ex Parte Application for a TRO and OSC re Preliminary Injunction. The Judge granted the TRO pending the OSC re Preliminary Injunction. Following oral arguments at the OSC re Preliminary Injunction, the Judge denied the Preliminary Injunction and Dissolved the TRO. The sale moved forward for $2,200,000 in cash., 2021
- This case involved defending a subcontractor who performed custom sound system wiring throughout a $14,000,000.00 home in Truckee, California. A little over a year after the wiring was performed, the entire property had a mold infestation in the walls. Damages sought exceeded $10,000.00. The subcontractor who performed the custom sound system wiring obtained a good faith settlement for $15,000.00., 2021
- Complete dismissal with prejudice on a personal injury action wherein the Plaintiff alleged damages in excess of $200,000.00 as a result of a motor vehicle accident., 2021
- This case involved a motor vehicle accident, in which the Plaintiff was alleging bodily injuries requiring extensive surgical procedures to be performed, as well as, a loss of earnings claim in excess of $200,000.00. Plaintiff's counsel made several demands to globally settle this claim for $100,000.00. This offer was denied and we appeared at the mandatory settlement conference, ultimately settling the claims against our client for $0 with a waiver of costs in exchange for a dismissal., 2020
- This claim involved tenants (whom were represented by firm), and had flooding their premises within a day of their lease beginning. Due to the flooding, the tenants had to reside in a hotel for nearly 30 days. Despite Santa Monica Municipal Code not being in our favor, we obtained a favorable settlement with the landlord. Particularly, the Santa Monica Municipal Code had a cap on on reimbursement for their expenditures. After it was all said and done, we were able to get around the cap on reimbursements, and the tenants were: (1) reimbursed for all of their expenses at the hotel (nearly $10,000); (2) not charged for rent for the month they were in the hotel, as well as, the following month; and (3) they were not charged for any other bills regarding the premises for that time as well., 2019
- We represented the Landlord in this claim, wherein his tenant (Claimant) sought a full refund of their security deposit based on allegations of mold. Following a detailed letter to Claimant's counsel explaining their unfounded allegations, the claim was dropped., 2019
- This case involved a motor vehicle accident, in which the Plaintiff was alleging bodily injuries requiring extensive surgical procedures to be performed. Initially, Plaintiff's counsel demanded the policy limits of the claim and following discovery proceedings, we identified the Plaintiff was involved in 3 prior motor vehicle accidents, wherein she hired the same attorney to settle claims. Notwithstanding, there was a mechanism of injury for Plaintiff's alleged injuries that could have resulted in a jury verdict greatly exceeding Plaintiff's demand. Following extensive negotiation, we settled the case for 3/4 less than Plaintiff's initial demand, despite extensive medical bills and treatment., 2019
- This case involved 21 causes of action, including but not limited to, sexual battery, assault, battery, negligent supervision, and a multitude of alleged violations of the California labor code against multiple entities. After several months, we mediated the case and Plaintiff's counsel demanded a settlement amount in excess of $5,000,000. During a 10 hour mediation, the crux of the allegations against my client depended upon how the business entities were set up. Following the 10 hour mediation, we settled for $10,000, which was over $5,000,000 less than Plaintiff's counsel initially demanded., 2019

- Written by Blaine M. Brown of OC Trial Group, APC, this article — published in the February 2025 issue of Orange County Lawyer Magazine — examines how anti-SLAPP motions have emerged as an increasingly effective strategic tool in California trust and estate litigation. The piece focuses specifically on scenarios where no-contest clauses are invoked as a litigation tactic to deter beneficiaries from asserting valid legal claims, and analyzes how anti-SLAPP motions can be leveraged to counteract that misuse and protect beneficiaries from the threat of unjust disinheritance in complex, high-stakes trust disputes., Turning the Tables: How Anti-SLAPP Motions Can Neutralize Enforcement of No-Contest Clauses in High-Stakes Trust Litigation, Legal Services, Trust & Estate Litigation, Probate Law, California Civil Procedure, Elder Law, 2025
- In this article, Blaine M. Brown provides a detailed analysis of the California Court of Appeal decision in Trotter v. Van Dyck, a landmark ruling reaffirming the importance of traditional formalities in trust amendments in the face of growing digital communication. The case examined whether emails and other informal electronic communications could serve as valid trust amendments under the Uniform Electronic Transactions Act (UETA). The court held that electronic communications do not satisfy the formal requirements for trust amendments, reinforcing the need for adherence to established legal standards. The article highlights the reaffirmation of formal, written instruments in documenting trust amendments and provides guidance for legal professionals to ensure clients' intentions are properly memorialized to avoid potential disputes., Lines Drawn in Digital Ink: Trotter v. - A beneficiary starts by making a clear written demand for a full accounting, and petitions the probate court if the trustee ignores or refuses it. This post explains what a proper account must contain under Probate Code section 16063, when accountings are owed under section 16062 and the related notice and reporting duties at sections 16061.7 and 16061, how to frame and document the written request, and what the court can do on a section 17200 petition, including compelling the account, surcharging the trustee under sections 16420 and 16440, and removal under section 15642. It also covers the limited exceptions under section 16064 and why a waiver is not absolute, what to scrutinize once an accounting arrives, and the three-year window that runs from an account disclosing a problem., How to Request an Accounting From a Trustee in California?, 2026
- A trustee who fails to safeguard trust property can be held personally responsible for the resulting losses. This post explains the duty to take control of and preserve trust assets under Probate Code section 16006 and the prudent investor standard of section 16047, the consequences that follow a breach — personal liability, removal under section 15642 including emergency suspension under subdivision (e), and a compelled accounting — and the common fact patterns that give rise to these claims, such as neglected real estate, uninsured assets, unsuitable investments, commingling, and missed tax deadlines. It then covers a beneficiary's remedies, including a section 17200 petition, surcharge under sections 16420 and 16440, double damages under section 859 for bad-faith conduct, and injunctive relief, along with the proof required and the three-year limitations period that runs from an account disclosing the breach., What Happens If a Trustee Fails to Protect Trust Assets in California?, 2026

It covers removal under section 15642 and why it is not automatic, the good-faith defense including the reliance protection of section 16040(b) and the court's discretion to excuse liability under section 16440(b), the resolution paths available short of trial, and the exposure a trustee faces if the claim succeeds, including personal liability and the remedies at sections 16420 and 16440., What Should I Do If I’m Accused of Mismanaging a Trust?, 2026
- A California trustee may hold up a distribution, but only where the delay serves a legitimate administrative purpose supported by the trust terms and Probate Code section 16000. It notes that California sets no fixed deadline but does impose the 60-day notice requirement of section 16061.7 and the annual accounting duty of section 16062, and it lays out a beneficiary's options when a delay is unjustified, including a section 17200 petition to compel distribution and removal under section 15642., Can a Trustee Delay a Trust Distribution to Protect Assets in California?, 2026

- Litigation arising between the beneficiaries and trustees appointed within a trust instrument is infrequent but common. For a comprehensive understanding, readers are encouraged to review articles on trusts, fiduciary duty, and trustee responsibilities available elsewhere on this website. When a trustee breaches a fiduciary duty, a beneficiary has the right to pursue legal action to ensure the trustee’s compliance with their obligations toward the trust. A beneficiary may petition the court for the removal of a trustee and seek remedies if the trustee is proven to have breached their fiduciary duty. It’s crucial to note that the beneficiary does not bear a fiduciary duty to the trust; rather, the trustee is obligated to act in the best interests of both beneficiaries and the trust. Personal liability may attach to a trustee who violates their fiduciary duties. Common claims often revolve around conflicts of interest, where trustees either benefit personally at the expense of the trust or neglect their duties, jeopardizing trust assets. The beneficiary typically follows a sequence of steps in such litigation, including retaining legal counsel, demanding a full accounting from the trustee, and, if necessary, seeking the trustee’s resignation and compensation to the trust or its beneficiaries. If the trustee refuses, legal action ensues, involving a petition for breach of fiduciary duties, removal as trustee, and payment for damages to the trust. During litigation, the trustee is defended by their legal counsel, which can lead to prolonged and expensive legal battles that can last for years. Interestingly, the trustee may still claim trustee fees as specified in the trust, even under accusation, creating a peculiar situation where the trust continues to pay fees to a trustee being sued by a beneficiary., Defending Litigation: Can a Trustee Utilize Trust and Estate Funds?, 2024

- Blaine M. Brown, a distinguished litigation attorney and proud alumnus of Western State College of Law, has carved a remarkable path from his days as a student to starting his own successful firm, OC Trial Group, APC. Within the first full year of operating, the firm collected over $5 million in settlements for their clients, including an award from Top Verdict for the #1 settlement in 2022 for Financial Elder Abuse, Constructive Fraud, and Embezzlement. As an undergraduate student, Blaine studied business administration with a focus on finance and accounting. This decision helped grow his business acumen, which was helpful when co-founding OC Trial Group, APC. He and his business partner, Ryan W. Young, started the firm about a year and a half ago. Growing up, Blaine was introduced to law at an early age by his father who is also a litigation attorney. “I’ve always wanted to be an attorney since I was five years old,” he said, adding that he was five when he attended his first jury trial. The early exposure to trials and legal proceedings, combined with a love of competition, laid the foundation for his future career. “I never wanted to sit behind a desk,” Blaine said. “I want competition and the win or lose aspect of law.” Blaine soon enrolled at Western State, drawn by its affordable tuition, practical approach to a legal education, and the opportunity to immerse himself in a vibrant, well-known legal community. As a student, he appreciated the accessibility of the faculty. “I was close with all my professors,” Blaine said. “Western State didn’t have professors who just knew the theory of law. Most had a practical background.” Blaine remains in contact with several of his professors from Western State. Blaine’s legal education was marked by hands-on experiences and dedicated study so that he felt prepared upon graduating. “The realistic application of law was one thing I enjoyed about the program,” he said. In addition to relationships with his professors, Blaine enjoyed connecting with his peers. “I talk to the people I went to law school with weekly,” he said. “You make a lot of friends who go on to practice different areas of law than you.” After graduating, Blaine quickly put his Western State education into practice. His firm, OC Trial Group, has since experienced a successful first year. Last December, an elderly lady, the beneficiary of a large trust consisting of an orchard, sought legal aid from Blaine. “The trustee had misappropriated a lot of money, exceeding 7 figures, and had hired a large firm with over 100 attorneys to defend her,” Blaine said. “Five days into trial, I ended up putting one of their partners on the stand and impeached her. We settled the next morning before trial for above what we asked for initially.” This high-profile case turned out to be the #1 settlement in 2022 for Financial Elder Abuse, Constructive Fraud, and Embezzlement in California according to Top Verdict. Blaine said the experience felt good and the success came from tireless preparation in investigating every aspect of the case, and developing a specific game plan to succeed. “We had just started the firm and went to trial six weeks later,” he said. “I’m still friends with the client. She was really grateful.” Blaine’s dedication to his profession extends beyond building his firm, from volunteering as a Moot Court judge at Western State and joining organizations like the Orange County Trial Lawyers Association. Last November, Blaine also assumed a position on the board of directors for the Veterans Legal Institute, which helps veterans battling all types of legal issues. “It’s an all-encompassing non-profit solely focused on assisting veterans,” Blaine said. “Although I’m not a veteran, my brothers are, and I thought it was a good cause.” In recognition of his contributions to the legal field, Blaine has been named to Best Lawyers’ annual list of “Ones to Watch”, and has also received an Avvo rating of “Superb 10/10” and a rating by Super Lawyers as a “Rising Star”. Looking ahead, he aspires to grow his firm, while maintaining a client-centric approach. His journey from a determined law student to a successful attorney exemplifies the transformative power of passion, perseverance, and a solid legal education, epitomizing the values espoused by Western State College of Law. He encourages students to persevere through law school. “If your end goal is to be an attorney, all your work is going to come to fruition if you continue working hard.”, Alumni Spotlight, Western State College of Law, 2024
