Verdicts/Settlements (Case Results):
  • Jamie recently obtained a Final Order for a Chapter 7 debtor allowing him to keep almost $140,000 in wages.  The case turned on whether Colorado's recent addition of an exemption in deposit accounts usurped the state's 150 year old wage exemption. The debtor had approximately $170,000 in a bank account on the Petition Date. The Chapter 7 Trustee objected to the exemption claim asserting the debtor could only exempt 80% of his wages earned in the week prior to the bankruptcy.  The Bankruptcy Court applied Colorado's liberal interpretation of bankruptcy laws noting the wage exemption decision from 1885 has never been overruled. The Court not only allowed the debtor to exempt all of the traceable wages in his account, but also permitted the "stacking" of the $2,500 deposit exemption. Thus, the debtor was able to keep most of his cash in his bank accounts.  See, In re Simpson, Case No. 22-11240-CDP (Bankr.D.Colo. May 23, 2023), 2023
