  • 2.2 million dollar birth injury settlementOn behlaf of the parents of a Cheyenne, Wyoming baby, Kevin Mahoney obtained a $2.2 million settlement from an obstetrician and a hospital. The mother had delivered her first child by Cesarean section, and, upon the advice of her obstetrician, was attempting a vaginal birth for her second child (VBAC). The fetal monitor strip showed signs of fetal distress, which went unnoticed by the labor and delivery nurse and the obstetrician. The mother's uterus eventually ruptured, extruding the baby into the abdomen. Going without oxygen for several minutes, the baby suffered permanent brain damage.

The decedent had undergone arthroscopic knee surgery and shortly thereafter developed chest pain and shortness of breath. The woman died two weeks later as a result of multiple pulmonary emboli.

The child's mother called her doctor's office the day before her son was born and told the nurse that she was experiencing decreased fetal movement. The nurse did not instruct the patient to come to the office or to the hospital to be evaluated. Twenty-four hours later, the mother's water broke and her son was delivered by emergency cesarean section. The child sustained catastrophic brain injuries., 2010
