Kevin Mahoney specializes in estate and trust litigation. He has tried cases to judges, juries, and arbitrators, and he has taken and defended more than 1,000 depositions, the vast majority of which were medical or economic experts. He spent several years as a partner at a Denver law firm where he handled medical malpractice and mass tort cases. He obtained several multi-million dollar verdicts against physicians and dentists, including the largest verdict against a dentist in Colorado history (Dosien v. Dorsey). Kevin now serves as personal counsel to physicians who are defendants in litigation. He has been practicing since 1995 and is licensed in both Colorado and Wyoming. He has been selected as a Colorado Super Lawyer every year since 2009 and has been named as a 5280 Top Lawyer every year since 2015.
Kevin attended college at Duke University where he was a four-year letterman on the varsity lacrosse team. He was chosen to the Atlantic Coast Conference Honor Roll during each of his four years of college. In 1991 he graduated magna cum laude from Duke with a double major in history and political science. He then attended Duke University School of Law, which is one of the top ten law schools in the country. He was a member of the law review at Duke and received the Note of the Year Award in 1994. In 1995, Kevin graduated in the top ten percent of his law school class.
Kevin has been a youth lacrosse coach for fifteen years. He was the head coach for all four of his children’s teams – two sons and two daughters. Kevin has coached dozens of players at the youth and high school level who went on to play Division I lacrosse in college, including more than 20 girls in the high school class of 2024.

- After a 2-day trial, the court ruled in favor of our client on all issues and invalidated a will based upon both undue influence and lack of capacity. The opposing party made no offer of settlement prior to trial., 2026

- $1.85 million settlement on behalf of a woman whose breast cancer was not treated in a timely manner., 2026
- After a three-day trial, successfully defended the validity of a Deed and claims for civil theft, breach of fiduciary duty, fraud, and unjust enrichment. Prior to trial, prevailed on a motion to dismiss several claims, which resulted in an award of attorneys' fees and costs being assessed against the opposing party., 2025
- Successfully reformed a will resulting in our clients inheriting a couple of million dollars they would not otherwise have inherited., 2025
- Defended the validity of a will executed by an elderly woman with dementia who had been hospitalized one week prior to executing her will. We settled the case with an extremely favorable result for our clients., 2025
- $1 million settlement on behalf of a woman who suffered a stroke due acute promyelocytic leukemia. Her primary care doctor failed to follow up on abnormal lab values, and as a result, her leukemia went untreated for more than six months resulting a stroke and severe neurological damage. We obtained a settlement for the doctor's insurance policy limits., 2025
- 2.2 million dollar birth injury settlement on behalf of the parents of a Cheyenne, Wyoming baby, Kevin Mahoney obtained a $2.2 million settlement from an obstetrician and a hospital. The mother had delivered her first child by Cesarean section, and, upon the advice of her obstetrician, was attempting a vaginal birth for her second child (VBAC). The fetal monitor strip showed signs of fetal distress, which went unnoticed by the labor and delivery nurse and the obstetrician. The mother's uterus eventually ruptured, extruding the baby into the abdomen. Going without oxygen for several minutes, the baby suffered permanent brain damage., 2020
- 3.4 million dollar birth injury settlement. The Mahoney Law Firm, P.C. secured a $3.4 million settlement on behalf of a six year-old Denver boy who suffered a brain injury at birth. There was an unreasonable delay in performing an emergency cesarean section. As a result, the baby suffered a brain injury from lack of oxygen. - 2 million dollar dental malpractice verdict. In 2017, The Mahoney Law Firm obtained the largest jury verdict in a dental malpractice case in the history of Colorado. The insurance company for the defendant-dentist never made any offer to settle the case. The jury returned an award of 2 million dollars, which was the entire amount claimed by our client., 2017
- 3 million dollar insurance bad faith settlement. Our firm represented a former all-pro N.F.L. football player who suffered a career-ending injury. His disability insurer denied the football player's claim for disability benefits. After filing a lawsuit, our firm was able to obtain a 3 million dollar settlement on behalf of our client., 2013
- 2 million dollar birth injury settlement Kevin Mahoney obtained a 2 million dollar settlement for the family of a ten year old girl who was injured at birth due to lack of oxygen. The child's mother was induced and the nurses failed to recognize signs of fetal distress., 2012
- 4.5 million dollar birth injury settlement Kevin Mahoney obtained a four and a half million dollar settlement on behalf of a three year-old boy who suffers from cerebral palsy due to lack of oxygen at birth. The child's mother called her doctor's office the day before her son was born and told the nurse that she was experiencing decreased fetal movement. The nurse did not instruct the patient to come to the office or to the hospital to be evaluated. Twenty-four hours later, the mother's water broke and her son was delivered by emergency cesarean section. The child sustained catastrophic brain injuries., 2010
- 1.75 million dollar Wyoming wrongful death settlement. Our firm obtained a 1.75 million dollar settlement for the widower of a 30 year-old woman who died from a pulmonary embolism. The decedent had undergone arthroscopic knee surgery and shortly thereafter developed chest pain and shortness of breath. None of the physicians that she saw for her complaints ever ordered a ventilation/perfusion scan or any other diagnostic test to rule out deep vein thrombosis or pulmonary emboli. The woman died two weeks later as a result of multiple pulmonary emboli., 2010
- 1.8 million dollar medical malpractice settlement after winning at arbitration. A Boulder woman received a 1.8 million dollar settlement from her family practice doctor after sustaining a serious injury which damaged her lungs and left her oxygen-dependant. The defendant-doctor refused to make any offer to settle the case so Kevin Mahoney arbitrated the case and won the case in front of the arbitrator., 2009
- 1.5 million dollar wrongful death settlement Kevin Mahoney obtained a 1.5 million dollar settlement on behalf of a man whose 38 year-old wife died after hysterectomy surgery. The woman showed signs of hypovolemic shock, but her surgeon did not take her back to the operating room to find the source of bleeding before she died., 2009

- What prepared me to practice in this area of law is the sheer volume of trial experience I gained over the years. For 25 years, I practiced as a plaintiff’s medical malpractice attorney, representing patients and families in lawsuits against doctors—cases that routinely went to trial. I served as lead trial counsel in more than 20 jury trials and have taken or defended more than a thousand depositions. That level of experience is significant compared to many attorneys in this practice area, and it has made me very comfortable going to trial and trying cases. Outside the office, I enjoy coaching youth sports. I grew up playing sports with three brothers, and we were very competitive. Looking back, I can admit we were idiots at times. Our Sunday routine was church, followed by a stop at King Soopers for donuts, and then watching professional wrestling—after which we would try the moves on each other. I played sports throughout my childhood and was very active. My wife was also an athlete, and I played high school and college lacrosse. I learned important life lessons and made lifelong friends through sports. Because of that, we were on the same page when we had children and wanted them involved in sports at a young age. I was fortunate enough to coach all four of my kids in lacrosse. It was not easy. Those were hectic years, as I was running my own law practice and often had to make up for coaching time by working late nights or weekends. Looking back, I have no regrets. I spent meaningful time with my kids and built lasting relationships with their friends and teammates. Coaching became a form of therapy for me. I could leave the stress of work behind, spend a couple of hours being present, laugh, act silly, and just enjoy myself.
