  • People In Interest of B.H., 507 P.3d 1089 (2022), Colorado Court of Appeals, Resolved a matter of first impression regarding post-trial motions in dependency and neglect proceedings, holding that filing a C.R.C.P. 59 motion does not toll the time to file a notice of appeal from termination judgments. This decision clarified critical appellate deadlines in child welfare cases.
  • People in Int. of L.S., 2023 CO 3M (Modified March 6, 2023), Colorado Supreme Court, Clarified the burden of proof in dependency and neglect cases, holding that the state satisfies its burden of proving no appropriate treatment plan can be devised when it establishes by a preponderance of evidence a single incident resulting in serious bodily injury to the child.
