- The Latitude at Vista Ridge Homeowners Assoc., Inc. v. Vista Ridge Development, LLC, et al. (Weld County District Court Case No. 2016CV30918). This was a multi-faceted construction defect case involving a homeowners association comprised of 124 single-family homes. Representing the Association, I was the first attorney to successfully argue that the representational standing provided to homeowner associations pursuant to Colorado’s Common Interest Ownership Act (“CCIOA”) extends to single-family home common interest communities., 2018
- Village at Cherry Creek Country Club Homeowners Assoc., Inc. v. C4 Land, LLC, et al. (Arapahoe County District Court, Case No. 2018CV30281). Colorado House Bill 1279 requires homeowner associations to conduct a meeting with the builder and a homeowner vote prior to asserting a claim. As now codified in C.R.S. § 38-33.3-303.5, these new requirements were believed to apply to any construction defect action filed on or after May 23, 2017. To date, I am the only attorney to successfully argue that the new Colorado requirements do not apply to any construction defect that was discovered by an association prior to September 1, 2017., 2018
- Vallagio North Assoc., Inc. v. Metropolitan Homes, Inc. et al. (Arapahoe County District Court, Case No. 2014CV31203). Complex construction defect case involving a multiuse association containing 90 residential units. Representing the Association, I successful avoided the binding arbitration clause contained in the Declaration and – following a two week trial – successfully obtained a jury returned a verdict in the amount of $5,818,172., 2015
- Latitudes at Vista Ridge Homeowners Association is a single family owners association. I was the first attorney to successfully argue that representational standing for an owners association provided for in CCIOA also applies to single family homes in common interest communities. This has grown our book of clients to include several single family home communities., 2018
- Shane was the primary bill-writer for Build Our Homes Right, a lobby group, during the 2024 Colorado Legislative Session. He co-wrote two bills (one extending the Statute of Repose and making it illegal for declarants to violate the non-profit act in HOA CCRs; and one bill to compel an study of construction insurance issues) and worked tirelessly to provide amendment language for three additional bills. Ultimately, none of them passed, but that is certainly a victory and a credit to Shane's work., 2024
