  • In two separate opimions handed down in 2009 and 2010 in Intermountain Insurance Services v. Commissioner of Internal Revenue, Mr. Anderson won a key victory in the U.S. Tax Court for taxpayers in partnerships. Among other important determinations, the Court held that an increase in basis does not constitute an understatement of income for statute of limitations purposes.  As of April 15, 2012, the case is pending in the U.S. Supreme Court. On March 26, 2012 Mr. Anderson won another important victory for taxpayers in Wandry v. Commissioner of Internal Revenue. The Wandry case has received a lot of attention from the Gift & Estate Planning Bar because it is the first of its kind where the Tax Court has upheld a defined value gift clause granting a gift not of a specific number of partnership units, as the IRS agued, but a gift of a specific value of Partnership interests
