Verdicts/Settlements:
  • In a decision that is believed to be the first reported case under C.G.S. Sec. 31-294i, a 49-year-old Greenwich firefighter who suffered a heart attack while driving to an emergency carbon monoxide alarm at a private home, was found entitled to workers’ compensation and other benefits.  The Town vigorously contested the case, arguing that the claimant did not suffer a cardiac emergency while he was engaged in fire duty at the site of a fire or accident, and also because of a significant family history of heart disease.  The Commissioner found the testimony of the claimant and his treating cardiologist more credible and persuasive than that of the Town’s medical expert.  Under the decision, the Town is required to pay for the significant permanent impairment to the heart that the firefighter suffered – potentially as much as $125,000 – and reinstate the sick and vacation time that he used while he was incapacitated from work., 2021
