Verdicts / Settlements (Case Results)

  • I successfully settled a disputed liability motor vehicle collision days before trial was scheduled for $900,000. Each party claimed that the other ran the red light. My client incurred over $200,000 in medical bills but they had been paid by health insurance and there wasn't a valid lien. My client had a fusion and was assigned a 26% PPD to the cervical spine but it was complicated by the fact that she had prior treatment and a subsequent injury. She had a small lost wage but had no impairment of earning claim. I had filed a timely Offer of Compromise for $800,000 which would have brought statutory interest back to the date of the filing of the Complaint if I prevailed at trial for $800,000 or more. The Defendant failed to timely accept the Offer of Compromise and once the time period ran I refused to accept $800,000. There was zero offer before I located and deposed an uncooperative witness who saw the color of the light after she heard the collision. After the witness deposition they offered $200,000 and we ultimately settled for $900,000, 2024
