- The Plaintiff was stuck in the side of her foot by a rock blasted from five hundred feet away. The blast rock penetrated the roof of Costco, where plaintiff was shopping, shattered on impact with the floor into a sandwich sized piece, slid across the floor before hitting her floor. Pictures taken on scene by fire rescue personnel showed no visible damage. Plaintiff claimed an injury to her plantar fascia. Defendant denied liability, even though Connecticut law provides that blasting companies are strictly liable for damage, and denied that plaintiff was injured to the extent when claimed. Plaintiff's expert was Russell Chiappeta, M.D. from Southington. Defendants expert were Michael Aranow, M.D. and Raymond Sullivan, M.D. both of Hartford. Last demand was $55,000.00. Last offer was 20,800.00. Verdict was $56,000.00, 2010
