A co-founder of Charmoy & Charmoy, Scott M. Charmoy divides his practice between foreclosure defense and bankruptcy. With offices in Fairfield and Stamford, Connecticut, he provides astute representation to clients throughout Fairfield County, including Bridgeport, Westport, and Norwalk. Mr. Charmoy has been admitted to practice before all Connecticut state courts since 1995 and before all Illinois state courts since 1996.
A significant portion of Mr. Charmoy's client base consists of area residents who have become overwhelmed by their financial obligations. His experience in this regard has included the two principal forms of consumer bankruptcy, Chapter 7 and Chapter 13. In the former, which is often referred to as liquidation bankruptcy, a person's nonexempt assets are sold by the trustee, with the proceeds being used to repay creditors. The remaining balances of most unsecured debts are then discharged. Chapter 13 bankruptcy is designed for people who have a steady source of income. Under this chapter, a debtor prepares and submits to the court for its approval of a repayment plan, which can last for up to five years. There are certain debts that receive priority for payment.
Mr. Charmoy has also represented creditors in these proceedings, and his experience also extends to Chapter 11 for business owners and their companies. He also provides advice and counsel to homeowners who are in default on their mortgages and who are in danger of losing their homes. He works with them in seeking mortgage modifications as well as in mediation and litigation. Mr. Charmoy received his Juris Doctor in 1995 from Washington University in St. Louis School of Law, and his professional affiliations include the National Association of Consumer Bankruptcy Attorneys.
