- Policy limits settlement totaling $500,000 for a 4-year old Palm Beach County girl whose pediatricians failed to diagnose her with bi-lateral hip dysplasia at birth. She required three separate reconstructive surgeries at age 4, and will have to endure at least one hip replacement in each hip before the age of 40., 2009
- TOTAL SETTLEMENT - $400,000 (Dog bite to a minor) An 8-year old attacked by a dog in May of 2008 obtained a settlement for insurance policy limits from two defendants after four months of litigation. The minor Plaintiff was playing in the back yard of a home in Sunrise, Florida when a Jack Russell terrier owned by the homeowner’s boyfriend bit her, causing severe lacerations to her cheek, eye lid and nasal passages. The minor Plaintiff underwent five separate surgeries to fix the numerous injuries, but still needs revision surgery to help lessen the visibility of the permanent facial scarring. The owner of the dog settled for his renters’ insurance policy limit of $100,000, while the owner of the home where the attack occurred settled for her homeowner’s insurance policy limit of $300,000. Plaintiff’s counsel negotiated for the purchase of an annuity which was guaranteed to more than triple the net recovery to the child during her lifetime. Counsel for the homeowner argued that a section of the applicable insurance policy excluded dog bite coverage if the dog was “owned or kept by you [the insured].” Case: Vicki Richard, as Parent and Guardian of a minor v.
