Daniel J. Di Matteo has experience in a diverse range of practice areas – from catastrophic personal injury to class actions to complex commercial litigation. He fully devotes his practice to complex civil litigation, with a focus on product liability and catastrophic personal injury actions. His work includes, but is not limited to, representing victims and consumers severely injured by dangerous medical devices, cosmetic products, and herbicide products. He is a zealous advocate for his clients’ interests.
An experienced litigator, Mr. DiMatteo has briefed and argued hundreds of substantive motions in federal and state court. He has taken and defended hundreds of fact witness, expert witness, and corporate representative depositions as well as cross-examined numerous defense experts in trial. He has defeated dozens of motions to dismiss and motions for summary judgment and obtained numerous favorable discovery orders. Since joining The Ferraro Law Firm in 2019, Mr. DiMatteo has counseled on cases that have resulted in multi-million-dollar settlements for the law firm’s clients. Some of Mr. DiMatteo’s notable recent work includes:
- Representing a catastrophically injured woman as lead counsel in a federal product liability case involving a defective transvaginal surgical device against Johnson & Johnson and Ethicon, Inc.
- Representing numerous landscapers and nurserymen with non-Hodgkin lymphoma and their families in state product liability cases involving Roundup herbicide against Monsanto Company
- Representing numerous women with ovarian cancer and their families in state product liability cases involving contaminated talcum powder against Johnson & Johnson, Inc.
- Represented a high net worth defendant in a high profile civil homicide and Uniform Fraudulent Transfer Act case
- Representing a nationwide class of retail investors alleging breach of fiduciary duty against one of the nation’s largest stockbrokers, In re: January 2021 Short Squeeze Trading Litigation, No. 21-MD-2989 (S.D. Fla. 2021)
- Defeated Monsanto Company’s motion for summary judgment in the matters of Wyzik v. Monsanto Co. and Armstrong v. Monsanto Co.
- Secured remand of a state product liability case to state court from bankruptcy court in the matter of Fransas v. Johnson & Johnson, Inc.
Prior to joining The Ferraro Law Firm in 2019, Mr. DiMatteo served as an Assistant County Attorney, where he represented government agencies as a trial attorney in personal injury and complex intergovernmental conflict cases. As an Assistant County Attorney, he honed his trial practice over three years of successfully trying numerous cases to verdict as lead counsel.
Mr. DiMatteo earned his law degree from the University of Florida, Levin College of Law. During law school, he was twice elected to the editorial board of the Florida Law Review, the highest-ranking law journal in the State of Florida, where he sharpened his legal research and writing skills. Mr. DiMatteo also obtained an invaluable insight into the inner workings of the federal court system as a judicial intern to the Honorable Paul C. Huck of the U.S. District Court for the Southern District of Florida. In that capacity, he researched and briefed contested legal issues for a senior federal judge, presented written and oral recommendations, and drafted proposed judicial opinions. Mr. DiMatteo received his undergraduate degree in History from the University of Florida.
Mr. DiMatteo has served on the Board of Directors of the Miami Beach Bar Association since 2016 and is a member of the Miami-Dade Trial Lawyers Association.
Mr. DiMatteo was recognized by the independent rating service Super Lawyers as a Rising Star, placing him among the top 2.5% of attorneys in the State of Florida who are 40 or younger or practicing 10 years or less in 2023.
