  • In re Via Airlines - Chapter 11 - Middle District of Florida (Orlando) - Successfully confirmed a Chapter 11 plan of reorganization over several creditor objections, including an objection lodged by the Office of the United States Trustee which was overruled in its entirety at a contested confirmation hearing. The confirmed plan restructured over $23 million of both secured and unsecured debt obligations including: (i) a $3.4 million dollar IRS tax claim which the airline successfully objected to and reduced to $223K; and (ii) a $1.4 million WARN Act claim which the airline also successfully objected to and reduced to $2K. The plan also featured a sale of the Debtor’s equity interests to Wexford Capital, LP, a private equity investor with over $3.9 billion in assets under management.
