Rocky Brancato doesn't take a case unless he's prepared to take it to trial. That philosophy — built over 25 years of criminal defense work in Tampa Bay — has shaped a career defined by serious cases, thorough preparation, and results.

Before opening his private practice, Rocky served as Chief Operations Officer of the Hillsborough County Public Defender's Office, where he led and mentored over 100 attorneys handling cases from simple misdemeanors to capital murder. He spent years in a specialized Major Crimes Unit defending clients accused of homicides, sex crimes, and child abuse — cases where the stakes are highest and the margin for error is zero.

Rocky is death-qualified, meaning he has the credentials and experience to handle capital cases where a client's life is on the line. He is also a member of the National College for DUI Defense (NCDD), reflecting his commitment to staying current on the science and strategy behind DUI defense.

What sets Rocky apart is his insider knowledge of how the system works. As a former police academy instructor, he trained officers on criminal procedure and courtroom testimony. He knows how law enforcement is taught to investigate, document, and testify — and he uses that knowledge to expose weaknesses in the State's case.

Rocky is known for his strategic use of expert witnesses to break down complex forensic, scientific, and technical evidence for judges and juries. He also has deep experience with mental health courts and diversion programs — alternatives that can keep the right clients out of the traditional criminal justice system entirely.

For over two decades, Rocky has trained and mentored hundreds of criminal defense attorneys across Tampa Bay and lectured statewide for Florida Bar credit. His peers have recognized him with an AV Preeminent rating from Martindale-Hubbell — the highest distinction for legal ability and ethical standards.

He is the author of How to Choose a Major Crimes Attorney — or Any Criminal Defense Attorney for That Matter, available on Amazon or as a free download at the firm's website.

The Brancato Law Firm handles the full spectrum of criminal charges — DUI, domestic violence, drug crimes, sex offenses, violent felonies, and homicide — for clients throughout Hillsborough, Pinellas, and Pasco Counties.

If you're facing criminal charges, the right attorney makes all the difference.

Verdicts / Settlements (Case Results)

  • Trafficking in Amphetamine – Charges Reduced, Diversion Secured - When prosecutors charged a client with trafficking in amphetamine, Rocky Brancato immediately challenged the State’s evidence. He filed a motion to suppress that exposed weaknesses in the case, creating leverage at the negotiation table. Rocky then secured a resolution reducing the charge and placing the client into a diversion program. Once the client completes a drug evaluation and any recommended outpatient treatment, the case will be dismissed., 2025
  • Felony Warrant and Case Dismissed for Out-of-State Visitor - Visitor lived under a Tampa felony warrant for years. Rocky gathered key facts, opened direct negotiations with the State Attorney’s Office, and persuaded them to quash the warrant and dismiss the case outright., 2025
  • Sexual Predator Designation Removed - Client had been wrongly designated a sexual predator years earlier. Rocky reviewed the sentencing record, identified the legal error, and filed corrective motions. When the court initially denied relief, Rocky drafted a persuasive motion for reconsideration that convinced both prosecutor and judge to remove the predator designation., 2025
  • False Arrest Avoided in Domestic Violence Case - Client faced arrest after an abusive ex falsely accused her of assault. Other attorneys advised surrender. Rocky intervened, contacted the intake prosecutor, and presented proof of her abuse. The warrant was recalled and charges dropped without her ever being booked or appearing in court. Rocky then secured a restraining order for her protection., 2025
  • Improper Sexual Predator Designation Corrected – Expanded Rights Secured - Rocky Brancato represented a man who had been improperly designated a sexual predator years earlier by another attorney’s handling of his case. After uncovering the error, Rocky successfully corrected the designation, reducing his client’s status to a sexual offender. With that crucial step achieved, Rocky then filed a motion requesting relief from the harsh restrictions that had limited his client’s life. The court granted internet access and approved contact with family children under a therapist-approved safety plan, allowing the client to move forward with greater freedom and dignity., 2025
  • Death Penalty Avoided in Capital Murder Cigarette Butt DNA Challenged) - In a 28-year-old Tampa cold case, prosecutors sought the death penalty against Rocky Brancato’s client based on DNA from a cigarette butt. Rocky and his team painstakingly reviewed every piece of stored evidence and uncovered serious concerns about how the cigarette butt had been preserved over decades. By challenging the reliability of that DNA, Rocky created the leverage to negotiate a plea that spared his client’s life. Instead of facing execution, the client resolved the case with a 50-year sentence.
  • Grandmother Cleared of Murder and Child Abuse - Prosecutors charged a grandmother with murder and aggravated child abuse after her granddaughter drowned. Rocky retained a forensic pathologist, deposed state experts, and demonstrated the liver injury came from CPR—not abuse. His preparation and expert use persuaded the prosecutor to dismiss the most serious charges, leaving only probation on a reduced neglect count.
  • Life Verdict in Death Penalty Case - In a high-profile capital trial, Rocky Brancato was part of a team that defended a client accused of killing a baby and facing the death penalty. Although the jury returned a guilty verdict, Rocky and the team’s penalty-phase strategy persuaded the jurors to reject death. By exposing weaknesses in the State’s aggravating factors and presenting compelling mitigation, they secured a life verdict, sparing the client from execution.
  • Not Guilty – Second-Degree Murder (Self-Defense) - Client accused of murdering his roommate. Rocky took the case to trial, framed the defense around lawful self-defense, and cross-examined key witnesses. The jury agreed, returning a full acquittal.
  • Cold-Case Sexual Battery – Charges Dismissed by DNA - Military veteran accused in a cold-hit DNA case. Rocky hired a DNA expert, directed a full review of the evidence, and guided expert testimony at deposition. The result: exclusion of the client as a contributor and dismissal of all charges.
  • Aggravated Child Abuse Charges Dismissed - Father accused of inflicting pancreatic trauma. Rocky obtained all medical records, retained a forensic pathologist, and built the defense that the injury came from a congenital cyst. Prosecutors dropped all charges after Rocky’s presentation of the evidence.
  • Not Guilty – Sexual Battery (Consensual Encounter) - A man in Ybor City was accused of sexual battery after a van encounter. Rocky’s cross-examination established inconsistencies and showed the encounter was consensual. The jury acquitted of sexual battery, convicting only on misdemeanor trespass.
  • Unlawful Sexual Conduct with Minor Dismissed - A 27-year-old client was accused of unlawful sexual contact with a 16-year-old. Rocky’s investigation uncovered social media proving the alleged victim misrepresented her age and gave inconsistent stories. Prosecutors dismissed the charge.
  • Lewd or Lascivious Conduct Reduced to Misdemeanor - Prosecutors relied on child testimony to charge a client with lewd or lascivious conduct. Rocky exposed inconsistencies in their accounts on cross-examination. The jury rejected the felony charge, convicting only on misdemeanor exposure. The client avoided sex-offender registration.
  • Not Guilty – Robbery with a Firearm (Mistaken Identity) - A man was charged with robbing a business at gunpoint. Rocky Brancato took the case to trial and built a mistaken identity defense. He highlighted a critical flaw in the State’s case: the victim never mentioned the client’s distinctive rosary tattoo covering his arm when describing the suspect. That omission created powerful reasonable doubt. After Rocky’s cross-examination and argument, the jury returned a Not Guilty verdict, fully acquitting his client.
  • Not Guilty – Trafficking in Cocaine (200–400 Grams) - A business manager was accused of trafficking 200–400 grams of cocaine after being arrested alongside a co-defendant. At trial, the co-defendant testified against him, hoping to shift blame. Rocky Brancato dismantled that testimony, presenting a defense that showed the co-defendant was the actual trafficker while his client was merely present. Through cross-examination and closing argument, Rocky highlighted the inconsistencies in the State’s case. The jury agreed and returned a Not Guilty verdict.
