- October 14, 2014. Client was pulled over in Coweta County by the Georgia State Patrol for speeding 82 in a 70 mph zone at 7:30 pm. Officer smelled an odor of green marijuana and observed bits of marijuana on his lips and in his teeth. Client was cooperative and polite. He exhibited no slurred speech or unsteadiness exiting his car. Client admitted to smoking marijuana at 2:00 pm earlier that day. Officer performed field test including: HGN with 0/6 clues, Walk and Turn test 4/8 clues, and one leg stand with 2/4 clues, Rhomberg balance test indicated a slow internal clock at estimating 30 seconds in 41 seconds, and lack of convergence with positive. Client was arrested for DUI drugs less safe. Blood test showed 28 ng of THCCOOH an inactive metabolite of marijuana which does not indicate any level of impairment. Active THC was not tested for by the Crime Lab. Video showed client driving fine, talking fine, walking fine as well as no clues on the one leg stand and walk and turn. Jury of 6 found client not guilty of DUI drugs less safe in one hour and 15 minutes. It is not a crime to drive with marijuana in your system without showing impairment. This case was handled by George Creal of George C. Creal, Jr. P.C., Trial Lawyers, 2014
- Client suffered from disabling pain that accompanies amputation after an infection from a flesh eating bacteria 20 years ago. With amputations drugs don't make you impaired. You start off impaired by disabling pain, and drugs enable you to be normal. Client was pulled over by police for allegedly weaving. She was forced to perform field sobriety evaluation which thankfully were video recorded and exposed the Officers exaggerations. A Coweta jury found our client NOT GUILTY of DUI which wasn't hard considering the video tape of the arrest. We conceded the FTML and they gave us a NOT GUILTY on that as well., 2013
