Greg Willis, founder of Willis Law Firm in Atlanta, Georgia, is a veteran defense attorney who devotes 90% of his practice to DUI defense. Representing clients throughout the Atlanta area and across Georgia, he has relentlessly defended individuals accused of impaired driving for nearly 30 years. Through strategic advocacy and rigorous trial preparation, he has successfully argued to expand the state and federal constitutional rights of his clients while maintaining an impressive 93.1% nonconviction rate.
Mr. Willis earned his Bachelor of Science in commerce from the University of Virginia in 1992, followed by his Juris Doctor from the University of Georgia School of Law in 1996. Licensed to practice in Georgia since 1996, he leverages his strong educational background and nearly three decades of trial experience to protect driver privileges. His steady dedication ensures every client receives a powerful defense grounded in deep technical knowledge and thorough constitutional analysis.
In 2019, Mr. Willis won a landmark Supreme Court of Georgia case (Elliott v. State), declaring DUI breath test refusal statutes unconstitutional. The court ruled that refusing a breath test is a constitutional right that cannot be used against defendants at trial, leading to suppressed test results statewide. By 2022, these constitutional protections expanded further to include field sobriety and urine tests, revolutionizing Georgia DUI defense and safeguarding vital constitutional rights for drivers.
Recognized for his relentless client advocacy, Mr. Willis earned the Georgia DUI Lawyer of the Year Award in 2018 for securing suitable outcomes. His uncompromising commitment to protecting drivers' rights also earned him the DUI Defense Lawyers Association's highest honor, the BadAss Award. These prestigious accolades reflect his fiery determination, deep respect for his clients and tireless work ethic, ensuring every individual receives a fierce, strategic defense during their most challenging legal moments.

Verdicts / Settlements (Case Results)
- Court of Appeals Win (3/28/24): Our client was charged for DUI while speeding with an open container. We appealed the decision in the court of appeals to suppress any evidence obtained pursuant to a search warrant for their blood and any statements made while in custody as involuntary, illegally obtained, and in violation of their Miranda rights. The judgment was reversed because the state lacked sufficient reliability because it contained illegally-obtained evidence.

Representative Clients
- Elliott v. State, 305 Ga. 179 (2019): Mr. Willis won a landmark Supreme Court of Georgia ruling holding that, under the Georgia Constitution, a defendant's refusal to take a breath test cannot be admitted as evidence against them at trial.
- McElrath v. Georgia (2024): Greg Willis filed the winning amicus curiae brief on behalf of the Georgia Association of Criminal Defense Lawyers (GACDL). The U.S. Supreme Court issued a unanimous decision holding that a verdict of "not guilty by reason of insanity" constitutes an acquittal under the Double Jeopardy Clause of the Fifth Amendment. The ruling has significant implications for defendants in Georgia who face re-prosecution after a mixed verdict. (Unanimous Victory)
- La Anyane v. Georgia: Greg has filed a petition for certiorari challenging the constitutionality of Georgia's implied consent statute. The petition asks the Supreme Court to address whether Georgia's implied consent framework, which allows prosecution of DUI refusal, violates the Fourth Amendment. The petition builds on the line of Georgia cases, including Elliott, limiting how refusals can be used. (Pending Petition)
- Johns v. Georgia (No. 25-689): This petition is currently before the United States Supreme Court. It represents the continuation of Greg Willis's appellate practice at the highest level of the American legal system. (Active Petition)
