Kelsey Grodzicki is the Managing Partner of Winter Capriola Zenner. He represents clients in a wide variety of complex civil litigation, bankruptcy, and arbitration matters involving contract disputes, real estate, quiet title actions, lien priority actions, collections and claims brought against landlords, title insurers, lenders, and individuals. Additionally, Kelsey routinely counsels companies, lenders, and title insurance companies in federal and state regulatory issues and related litigation. Kelsey also handles a wide variety of matters, including commercial collections, breach of contract claims and tort claims such as fraud, negligent misrepresentation, embezzlement, and breach of fiduciary duties.

Kelsey has litigated hundreds of cases in both state and federal courts, including the Georgia Supreme Court, Georgia Court of Appeals, and the U.S. Courts of Appeals for the 6th and 11th Circuits.

He frequently speaks and writes about real estate related topics. Most notably, he authored the book: “LexisNexis Practice Guide: Georgia Real Estate Litigation”. He is also an attorney author for LexisNexis’s Practical Guidance® section where he writes real estate related articles and practice notes to assist other legal professionals in their practice of law. Kelsey has been featured in various trade magazines regarding mortgage regulatory compliance and other topics. Kelsey has been selected as a SuperLawyers Georgia Rising Star from 2017 through 2023, which selection has been showcased in the Atlanta Magazine and the Atlanta Business Chronicle. He is actively involved in both the Atlanta Bar Association and the State Bar of Georgia, and was appointed to the State Bar’s Georgia Diversity Program Committee, an initiative dedicated to advancing diversity and inclusion within the legal profession.

Kelsey is a 2024 graduate of Leadership Gwinnett and is on the Board of Trustees for the North Gwinnett Schools Foundation. He is also a board member for the North Gwinnett Football Association.

Prior to joining Winter Capriola Zenner, LLC, Kelsey was the managing attorney overseeing the litigation practice at a mid-sized law firm based in Atlanta, Georgia. Kelsey is originally from Atlanta, Georgia where he attended and graduated from Marist. He also graduated from Furman University and received his J.D. from Stetson University College of Law.

  • Represented an owner of multiple rental properties and obtained a $200,000 judgment on the owner's behalf against the property management company for breach of contract, breach of fiduciary duty, conversion and misappropriation. , 2024
  • Obtained a $63,000 judgment for a landlord in a landlord tenant trial., 2025
  • Obtained a complete win for client in a bench trial in the Northern District of Georgia.  This was a case made for Netflix. A romance scam involving millions of dollars, insinuations of spy craft, fancy foreign trips, a loan to a famous band for its concert series, and a multitude of shell companies meant to obfuscate the trail of money. At trial we successfully unveiled the opposing party’s scheme to defraud creditors and conceal assets, defeating the claims that our client converted more than $1.5 million and a home. We prevailed on our clients claims for fraud, money had and received, and breach of personalty. The court also awarded attorneys fees to our client. , 2024
  • Won a Motion for Judgment on the Pleadings in a case resulting from another trial court overstepping its authority in dividing real property in a divorce case. As parents are apt to do, a father bought his daughter a home and titled it in his and her name. The daughter and her husband lived in the home as their marital property. As part of the divorce decree, without making the father a party to the case, the trial court judge took title to the property from the father and awarded half to the daughter and half to her now ex-husband. The ex-husband filed a new lawsuit seeking a statutory partition of the property. We successfully argued that the divorce court lacked authority to dispose of the father’s property without him being a party to the case and dismissed the ex-husband’s case with prejudice. , 2025
  • Won a bench trial representing a lender in a reformation case where conveyance and loan documents only conveyed a part of the development. This case was about correcting a mistake that could have unfairly benefited the defendant at our client's expense. At the heart of this dispute was real property ownership and intent. Our client, a lender, lent money on a developer-to-developer land sale. The original developer had a combination plat claiming all lots were merged into one lot. Before selling, he substantially completed a large home.  However, due to a mistake, only 7 of the 8 acres were transferred—leaving a critical 1-acre parcel in dispute. Despite originally combining the parcels and acting as though they were one, the defendant claimed to still own the 1-acre lot after selling the entire property for a substantial profit. Through meticulous document review and a deep dive into all of the communications and documents prepared leading up to the closing, we demonstrated that equity and fairness dictated one outcome: title to the full 8 acres rightfully belonged to our client.
