As a partner at Lotito & Kirschenbaum, of Atlanta, Georgia, Nicholas A. Lotito focuses on criminal defense representation for persons facing various federal and state charges. Mr. Lotito has represented defendants in 17 states achieving acquittals and dismissals for clients accused of Rico, mail, wire and securities fraud, Ponzi scheme conspiracies, bribery, money laundering, drug conspiracy, armed robbery, operating a chop shop, altered VIN allegations, criminal embargo offenses, Medicaid fraud, vehicular homicide, aggravated assault and murder, among other criminal charges. Mr. Lotito represents corporations and individuals in connection with amnesty applications to the Antitrust Division of the U.S. Department of Justice and has defended clients accused of price-fixing, bid rigging and criminal antitrust charges. He is experienced with grand jury investigations and criminal appeals. Clients include doctors, lawyers, pharmacists, veterinarians, nurses and other professionals, where licensing issues are often implicated, and many others who have needed representation.
After graduating from Emory University with a BA in history in 1971, Mr. Lotito attended the University of Virginia School of Law. Upon earning his Juris Doctor in 1975, he was admitted to the State Bar of Georgia. He is also admitted to practice before the U.S. District Court for the Northern District of Georgia, the U.S. Circuit Courts of Appeals for the 4th, 5th and 11th Circuits, the Georgia Court of Appeals and Supreme Court and the Supreme Court of the United States. Prior to joining Davis, Zipperman, Kirschenbaum & Lotito, LLP, Mr. Lotito held positions with the Federal Trade Commission and the Antitrust Division of the U.S. Department of Justice.
Mr. Lotito is a member of the Criminal, Antitrust and Litigation Sections of the American Bar Association and has also earned an AV Preeminent* rating from Martindale-Hubbell. He is a past president of the Georgia Association of Criminal Defense Lawyers. He also chaired its amicus committee for 10 years. He is a longtime member of the National Association of Criminal Defense Lawyers and the Lawyers Club of Atlanta. Mr. Lotito received a Special Achievement Award from the U.S. Department of Justice, was twice named as a member of the Legal Elite by Georgia Trend Magazine and has an AVVO rating of 10.0. Mr. Lotito served as a visiting professor of criminal law in Vladivostok, Russia and Rijeka, Croatia. In the summer of 2003, he graduated from the Trial Lawyers College.
