Verdicts/Settlements

  • $400,000.00 policy limits settlement for our client who underwent spinal fusion surgery after he was hit by a drunk driver.  Our client's own insurance company initially tried to deny Med Pay coverage for the surgery.  We sued the insurance company for bad-faith in denying the claim and was able recover an additional $50,000.00 for our client plus and additional $20,000.00 in attorneys' fees and costs. , 2019
  • $750,000 brain injury settlement arising from a read-end motor vehicle collision. , 2020
  • $1.6 million brain injury settlement against a corporate defendant who remains confidential due to settlement terms.  , 2020
  • $450,000.00 settlement in automobile collision case where our client was struck by a truck and suffered herniated discs that required fusion surgery. , 2016
  • Wrongful death medical malpractice confidential settlement where a hospital negligently gave a patient an improper combination of anti-coagulant and pain medications, then failed to properly monitor the patient after she suffered a perforation of her intestine during surgery.  The patient died from internal bleeding complications.  The case was settled for a confidential amount at the request of the hospital's insurance carrier. , 2014
  • $300,000.00 total settlement for our client who suffered a herniated disc that required surgery after being involved in a car wreck.  The at-fault driver's insurance quickly offered their $100,000.00 policy limits but our client's Underinsured Motorist carrier insurance initially refused to pay its $200,000.00 policy limits, claiming that the injury may not have been related to the wreck.  We filed suit on behalf of our client and obtained several favorable reports from her treating doctors and surgeon that all linked her injuries to the wreck.  The insurance carrier ultimately relented and paid its full policy limits after trying several times to make lesser settlement offers. , 2015
  • $250,000.00 settlement with trucking company after their driver improperly turned left in front of our client coming from the other direction, causing a collision that led to a bulging disc and fractured vertebrae in his lower back., 2015
  • $330,000.00 settlement when a drunk driver who crossed the center line and hit our client head-on.  Our client suffered a torn ACL and had to have knee surgery.  The at-fault driver initally claimed to have only had one glass of wine before driving, but our further investigation revealed several inconsistencies in his statement that indicated he had been drinking much more.  The case settled for the full insurance policy limits soon after we completed our investigation.  , 2017
  • A confidential settlement was reached in the wrongful death claim against a Georgia nursing home after our investigation showed the nursing home failed to provide proper care and monitoring to a patient with a trachea tube to assist in her breathing.  The patient slowly asphixiated over a period of several days.  The settlement was made confidential at the request of the insurance carrier for the nursing home.
  • Confidential settlement for a young man who suffered a traumatic brain injury at a private facility for troubled youths.  Our client was beat up by another resident who had a history of violent behavior.  Our client suffered a fractured skull and permanent after-effects from his brain injury.  The facility denied liability for our client's injuries and fought bitterly to contest our case.  Our investigation uncovered a surveillance video of the attack as well as admissions by the staff counselors that they were playing cards at the time of the attack rather than supervising the kids as they were supposed to be doing.  The exact amount of the settlement was made confidential at the request of the facility's insurance carrier. , 2018
  • Won a case before the Georgia Supreme Court that establishes new medical privacy rights for individuals who bring personal injury lawsuits.  Baker v. Wellstar Health System, Inc., 288 Ga. 336 (2010)
  • $550,000.00 medical malpractice verdict, plus $54,000.00 in prejudgment interest, for man who sustained nerve damage in his right hand following a negligent needle injection. Spradlin v. Wellstar Health System, Inc., Cobb County State Court, Judge Russell Carlisle, 2007
