- Veley v. Beverly, 19 L 1494: Obtained summary judgment on behalf of a landscaping company in a lawsuit stemming from a slip and fall on ice in Cook County. Post-Mickens, we argued that while the contractor did owe Plaintiff a duty, she could not prove that duty was breached or that services were provided in a negligent fashion.
- Secured voluntary dismissal for clients following presentment of Rule 619 motion demonstrating lack of onsite presence and easily disproved allegations of fact
- Represented a commercial landlord in a lawsuit by a former building employee, alleging injury for a premises defect.
- Took the lead role in coordinating settlement of several multi-party construction cases, balancing various party roles and insurance obligations accordingly.
- Negotiated numerous nominal or highly compromised settlements of significant value natural accumulation cases during pendency of a summary judgment motion.
- Negotiated nominal settlement in product liability action against auto manufacturer and dealer relative to alleged automotive defect causing accident and injury.
- Secured dismissal with prejudice of a lawsuit against contractor supplying hot water heaters to a residential co-op, with only concession being that each side to bear its own costs after initial indication that no offer less than $1M would be considered.
- Favorably resolved, after one week of trial, a construction negligence action by an injured worker claiming Complex Regional Pain Syndrome and loss of trade, settling in the low six figures following a $9M demand.
- Wiberg v. Soil & Material Consultants, 19 L 1296: Won a motion to dismiss our client from a significant construction case involving a career-ending injury to a union carpenter. Ultimately the Court agreed that our client did not cause or contribute to the presence of the dangerous condition in any way, granting an early dismissal.
- Yolich v. Food 4 Less, 20-cv-4872: Earned summary judgment from a federal magistrate judge on behalf of a grocery chain after a slip and fall by a customer.
- Salgado v. Benchmark Construction Co., 20 L 4053: Obtained summary judgment in a long-running construction negligence case that resulted in the death of a tradesman who was crushed between sewer piping on a project in the City of Chicago. Summary judgment allowed our client to avoid any further involvement in a case where Plaintiff will likely ask a jury for an eight or nine-figure judgment to compensate him for the wrongful death of his son.
- Ray v. Sledzinski, 19 L 11727: Secured summary judgment on behalf of a landowner for a slip and fall on ice by a tenant. While Plaintiff suggested multiple theories for the ice’s origin, we successfully argued that “mere possibilities” should be ignored by the Court.
