The founder and president of the Illinois-based firm Incubate IP, Randy Micheletti is an intellectual property attorney known for assisting his clients in securing patents, trademarks, copyrights, licensing and handling deal negligence. He is passionate about helping startups and provides his service to companies and professionals across Chicago and nationwide and represents them before the U.S. Patent and Trademark Office and the U.S. District Court for the Northern District of Illinois.

Graduating from Augustana College in Rock Island, Mr. Micheletti earned his undergraduate degree in chemistry in 1998 and later his master’s degree from the University of Pittsburg in 2001. After working as a product manager and education coordinator for half a decade, he enrolled in the Chicago-Kent College of Law at the Illinois Institute of Technology and received his Juris Doctor in 2009. He was inducted into the Order of the Coif for excelling in his legal studies.

Before establishing his firm, Mr. Micheletti gained experience as an associate attorney at several esteemed organizations based out of Chicago.

Whether it’s acquiring a new company or securing a patent for the company’s new technology, Mr. Micheletti brings his A-game to the table to help out his clients. He understands how important it is to patent and copyright products and technology on time and thereby protecting a company’s service and ensuring that the technology remains unique to them. He works tirelessly to ensure that his client’s IP portfolio is well built, maintained and managed properly.

Mr. Micheletti serves as an adjunct professor at his alma mater in his spare time and is a court-appointed guardian ad litem at Chicago Volunteer Legal Services.

  • Patent infringement lawsuits place over $15 billion in corporate assets at risk each year. Compensatory damages for infringement--often exceeding $10 million per suit--may be enhanced when the patentee proves, by clear and convincing evidence, that the defendant willfully infringed the patent. Willful infringement has traditionally been a subjective inquiry, but the Federal Circuit recently adopted an objective standard in In re Seagate Technology. The court delegated responsibility for development of the new standard to future cases.
