  • While driving home, a Warren County motorcyclist’s life was changed forever. The defendant, a man in his late 80s, made a left turn immediately in front of our client causing a collision. As a result of the accident, our client was severely injured and had medical bills totaling nearly $110,000.00. While the insurance company offered to pay its $100,000.00 policy limits, this was not satisfactory given the severity of the biker’s injuries. Hupy and Abraham filed a lawsuit against the defendant and proceeded with litigation. It was discovered by Attorneys Vito J. Manicioto and Tim W. Schelwat that the defendant at the time of the accident was making a left turn into a private driveway of farmland he owned. Additional investigation revealed that the defendant had substantial assets. Attorneys Vito J. Manicioto and Tim W. Schelwat were able to negotiate an additional $90,000.00 to be paid from the defendant personally out of his own assets. This money was in addition to the insurance company’s $100,000.00 policy limits which they also tendered., 2011
  • An Iowa man was injured working as an independent contractor as a truck driver in Illinois. After he exited his truck and began to cross the street, he was struck by a negligent driver. After being rushed to the hospital, he was discharged several days later, thankfully, with soft tissue injuries and no fractures. Although a subsequent MRI revealed damage to one of his shoulders that ultimately required surgery to repair. After getting the run around from the insurance company for a couple of months, the man hired Hupy and Abraham. Attorney Vito Manicioto was able to get the policy limits from the negligent driver’s insurance in Illinois. Attorney Manicioto also collected the policy limits for the underinsured motorist coverage from the truck owner’s insurance for whom he was driving for in Illinois. Unfortunately, this was still not enough to compensate the man, so Attorney Manicioto negotiated with the insurance company for the man’s personal Iowa policy to tender its policy limits, as well for its underinsured coverage. This was one accident that resulted in tendering of policy limits from three insurance companies in two different states., 2016

She was traveling past the Waukegan High School parking lot when a car pulled out and struck her vehicle with such force it pushed her vehicle into a third vehicle. She was transported to the hospital by ambulance and diagnosed with a fractured ankle among other soft tissue injuries. Her ankle was casted and she was discharged. Due to the slow healing of the fracture, she required surgery and subsequent physical therapy. The insurance company started negotiations at $200,000.00, which was immediately rejected by Attorney Vito Manicioto. Attorney Manicioto was able to settle the case without filing a lawsuit for over $400,000.00.   • On a July morning, a 67-year-old woman from Clinton, Illinois, was traveling to work when a vehicle owned by a not-for-profit corporation made a left turn into the front of her vehicle. The force of this collision caused severe injuries to both of her ankles. She underwent several surgeries to repair the damage. After the insurance company refused to disclose the full amount of their insurance coverage, Attorney Vito Manicioto immediately filed a lawsuit.   • On a July afternoon in 2008, a McHenry County man was traveling home from work when the defendant made a left turn immediately in his path causing a horrific accident. From the force of the impact, the defendant’s car flipped over and killed him. Our client was lucky to survive and spent several days in the hospital. This client came to Hupy and Abraham just two weeks before the statute of limitations was about to expire on his case after losing confidence in his first attorney. He told Hupy and Abraham that his claim was initially denied by the insurance company that stated he was not keeping a proper look out for the left-turning vehicle. Our Gurnee, Illinois, office immediately filed a lawsuit and began litigating the case. Due to the severity of the collision, our client did not have a clear recollection of the accident. With the defendant killed in the accident, there was not a clear picture of what took place that day. Attorney Vito J. Manicioto was able to piece together what happened through witness testimony and several officers’ depositions. The insurance company, after much litigation, agreed to pay their $100,000.00 injury limits. The $100,000.00 policy limits were not enough to fairly compensate our client. Attorney Manicioto found additional assets in the estate of the deceased defendant and would not settle. After filing documents in the probate action for the defendant and much negotiating, Attorney Manicioto was able to secure an additional $30,000.00 over the insurance policy limits for a total settlement of $130,000.00., 2012
  • A Wisconsin woman was severely injured while a motorcycle passenger in McHenry County, Illinois. After a long weekend of riding, the woman and family member were returning to a relative’s home when they were rear-ended while slowing to make a right turn. The woman sustained severe injuries requiring multiple surgeries. The insurance company started negotiating with very low offers.
